Everyone has the right to work and to earn a decent living. Employment is obtained through a work agreement made in writing or unwritten. This research uses a normative juridical analysis method with a statutory approach and a case approach. Written work agreements and written work agreements still have legal force and to prove it in court requires two witnesses or one witness with other testimony. According to civil law and labour law, unwritten work agreements bind the parties as long as they fulfil the terms and elements of the agreement.
