This study aims to analyze the application of punishment for children in conflict with the law, particularly those who commit sexual offences against fellow children. The growing involvement of minors as perpetrators of sexual crimes presents a legal dilemma, as both offenders and victims are equally entitled to protection. This issue calls for a legal approach that is fair, humanistic, and consistent with the principles of child protection. The research employs a normative juridical method using a statutory approach and case studies, including the 2024 case handled by the Bintan Police. The novelty of this study lies in examining the gap between the principles of diversion, restorative justice, and the doctrine of ultimum remedium as regulated in Law No. 11 of 2012 on the Juvenile Criminal Justice System and their practical implementation in the field. The findings indicate that judicial decisions concerning child perpetrators of sexual offences remain caught in a dilemma between punitive measures and rehabilitative approaches, influenced by legal, psychological, social, and sociological factors. This study concludes that consistent application of restorative justice, strengthening the role of juvenile correctional institutions (LPKA), and the formulation of technical guidelines for juvenile judges are essential to ensure that sentences are not merely repressive but also rehabilitative and aligned with the best interests of the child. Penelitian ini bertujuan untuk menganalisis penerapan hukuman terhadap anak yang berhadapan dengan hukum, khususnya sebagai pelaku tindak pidana asusila terhadap sesama anak. Peningkatan keterlibatan anak sebagai pelaku kejahatan seksual menimbulkan dilema hukum, karena pelaku dan korban sama-sama memiliki hak perlindungan. Permasalahan ini menuntut pendekatan hukum yang adil, humanis, dan sesuai dengan prinsip perlindungan anak. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan studi kasus, salah satunya kasus pada Polres Bintan tahun 2024. Kebaruan penelitian ini terletak pada analisis kesenjangan antara prinsip diversi, keadilan restoratif, dan asas ultimum remedium yang diatur dalam UU No. 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak dengan praktik penegakan hukum di lapangan. Hasil penelitian menunjukkan bahwa putusan terhadap anak pelaku tindak pidana asusila masih menghadapi dilema antara pembinaan dan pemidanaan, dengan faktor yuridis, psikologis, sosial, serta sosiologis yang turut memengaruhi pertimbangan hakim. Penelitian ini menyimpulkan perlunya konsistensi penerapan prinsip restorative justice, penguatan fungsi LPKA, serta pedoman teknis bagi hakim anak agar putusan tidak hanya bersifat represif, tetapi juga rehabilitatif dan berorientasi pada kepentingan terbaik bagi anak.
