Abstract

ABSTRACT The development of the K-Pop album pre-order system through digital platforms has raised consumer protection issues, as seen in the case of WONUSLIEBE in the pre-order of SEVENTEEN's FML album in 2023. The business failed to fulfill its obligation to deliver the goods after consumers made their payments. This study aims to analyze consumer protection in sales agreements for K-Pop albums and merchandise through the pre-order system at Wonusliebe based on Law Number 8 of 1999 concerning Consumer Protection, as well as to analyze the legal consequences of default in pre-order refund agreements at Wonusliebe This research uses a normative legal research method with a descriptive-analytical nature. The approaches used include a legal approach, a conceptual approach, and a case approach. The data used consists of primary legal materials, including the 1945 Constitution, the Civil Code, Law No. 8 of 1999, and Law No. 11 of 2008 along with its amendments, as well as secondary legal materials in the form of literature and legal journals. Data collection techniques were conducted through literature review and document analysis, with data analysis using qualitative methods. The result show that consumer protection in pre-order transactions for K-Pop albums and merchandise on Wonusliebe is still not optimal. Although there is an adequate legal framework, in practice, violations of consumer rights still occur, specifically violations of Article 4(b) and (c), Article 7(a) and (b), and Article 8(1)(f) of the Consumer Protection Law. This indicates a gap between ideal law and reality on the ground. Legal protection for consumers can be achieved through preventive and repressive approaches. The breach of contract committed by Wonusliebe's business actors results in legal consequences in the form of an obligation to compensate consumers, consisting of a breach of contract in the pre-order sales agreement and a breach of contract in the refund agreement. Dispute resolution is prioritized through amicable means, while still leaving open the possibility of court proceedings if mediation fails Keywords: Consumer Protection, Pre-Order, Default ABSTRAK Perkembangan sistem pre-order album K-Pop melalui platform digital menimbulkan permasalahan perlindungan konsumen, seperti yang terjadi pada kasus WONUSLIEBE dalam pre-order album SEVENTEEN-FML tahun 2023. Pelaku usaha gagal memenuhi kewajiban penyerahan barang setelah konsumen melakukan pembayaran. Penelitian ini bertujuan untuk menganalisis perlindungan konsumen dalam perjanjian jual beli album dan merchandise K-Pop melalui sistem pre-order di Wonusliebe berdasarkan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, serta menganalisis akibat hukum wanprestasi dalam perjanjian pengembalian dana pre-order di Wonusliebe. Penelitian ini menggunakan metode penelitian hukum normatif dengan sifat deskriptif-analitis. Pendekatan yang digunakan meliputi pendekatan studi kasus, pendekatan perundang-undangan, dan pendekatan konseptual. Data yang digunakan berupa bahan hukum primer yang terdiri dari UUD 1945, KUHPerdata, UU No. 8 Tahun 1999, dan UU No. 11 Tahun 2008 beserta perubahannya, serta bahan hukum sekunder berupa literatur dan jurnal hukum. Teknik pengumpulan data dilakukan melalui studi kepustakaan dan studi dokumen, dengan analisis data menggunakan metode kualitatif. Hasil penelitian menunjukkan bahwa perlindungan konsumen dalam transaksi pre-order album dan merchandise K-Pop di Wonusliebe masih belum optimal. Meskipun telah ada kerangka hukum yang memadai, dalam praktiknya masih terjadi pelanggaran terhadap hak-hak konsumen berupa pelanggaran Pasal 4 huruf b dan c, Pasal 7 huruf a dan b, serta Pasal 8 ayat (1) huruf f UUPK. Hal ini menunjukkan adanya kesenjangan antara hukum ideal dan kenyataan di lapangan. Perlindungan hukum bagi konsumen dapat dilakukan melalui pendekatan preventif dan represif. Wanprestasi yang dilakukan oleh pelaku usaha Wonusliebe menimbulkan akibat hukum berupa kewajiban memberikan ganti rugi kepada konsumen, yang terdiri dari wanprestasi dalam perjanjian jual beli pre-order dan wanprestasi dalam perjanjian pengembalian dana. Penyelesaian sengketa diprioritaskan melalui jalur kekeluargaan dengan tetap membuka kemungkinan jalur pengadilan jika musyawarah gagal. Kata Kunci: Perlindungan Konsumen, Pre-Order, Wanprestasi
