<![CDATA[ABSTRACTVillage Owned Enterprises is a business entity whose capital is wholly or largely owned by the village through direct participation originating from village assets which are separated to manage assets, services and other businesses for the greatest welfare of the village community. The lack of effectiveness in implementing Village Owned Enterprises often becomes a polemic that arises within the village community, especially if Village Owned Enterprises is in a vacuum or seems to exist and not exist. In this regard, this also happened in Sungai Besar Village, Batu Ampar District, Kubu Raya Regency. Sungai Besar Village Owned Enterprises, was formed on 01 September 2022 based on the Registration Certificate of Legal Entity Establishment of the Ministry of Law and Human Rights of the Republic of Indonesia Number: AHU-06962.AH.01.33 of 2022 with the name "Mekar Lestari". Village Owned Enterprises "Mekar Lestari" Sungai Besar, is regulated through Sungai Besar Village Regulation Number 2 of 2022 concerning the Establishment of Village-Owned Enterprises and Regulation of the Head of Sungai Besar Village Number 1 of 2022 concerning Bylaws of the Sungai Besar Mekar Lestari Village-Owned Enterprise. Village Owned Enterprises "Mekar Lestari" Sungai Besar, received initial capital participation from the Sungai Besar Village Government in 2023 amounting to IDR. 50,000,000. The capital investment obtained by Mekar Lestari Sungai Besar Village Owned Enterprises is used for business activities in accommodating community copra proceeds, providing diesel fuel for fishermen, and accommodating fishermen's sea products, such as shrimp, fish and squid as stated in the Attachment to the Sungai Besar Village Regulations Number 2 of 2022 concerning the Establishment of Village-Owned Enterprises. However, in fact, Mekar Lestari Sungai Besar Village Owned Enterprises, has not carried out its business activities as stated in the Attachment to Sungai Besar Village Regulation Number 2 of 2022 concerning the Establishment of Village-Owned Enterprises to date. The reason why Mekar Lestari Sungai Besar Village Owned Enterprises, has not carried out its business activities is because the selling value of copra is currently experiencing a significant decline, where the current price of copra sold to the most expensive container per kilogram is only IDR. 4,500. while in 2022 the price of copra per kilogram will reach IDR. 8,000. Likewise, the selling value of marine products such as fish, shrimp and squid has increased due to the increase in fuel oil prices, so that Mekar Lestari Sungai Besar Village Owned Enterprises is unable to accommodate fishermen's marine products. Then the provision of diesel fuel for fishermen has been attempted by Mekar Lestari Sungai Besar Village Owned Enterprises, but they are still waiting for a recommendation permit from the Regent of Kubu Raya which has not yet been issued, so the provision of diesel fuel for fishermen cannot be realized. The efforts made by the Mekar Lestari Sungai Besar Village Owned Enterprise, to carry out its business activities are to continue carrying out business activities in accordance with the Articles of Association of Mekar Lestari Sungai Besar Village-Owned Enterprise, such as selling pesticides required by farmers, even with capital that is considered minimal. Apart from that, Mekar Lestari Sungai Besar, Village Owned Enterprise asked for additional capital participation from the Sungai Besar Village Government, so that it can carry out its business activities optimally. ABSTRAK Badan Usaha Milik Desa (BUM Desa) adalah badan usaha yang seluruh atau sebagian besar modalnya dimiliki oleh desa melalui penyertaan secara langsung yang berasal dari kekayaan desa yang dipisahkan guna mengelola aset, jasa pelayanan, dan usaha lainnya untuk sebesar-besarnya kesejahteraan masyarakat desa. Kurang efektifnya dalam pelaksanaan BUM Desa seringkali menjadi polemik yang timbul dalam tatanan masyarakat desa, apalagi jika BUM Desa itu vakum atau seperti ada dan tiada. Berkaitan dengan hal tersebut, juga terjadi di Desa Sungai Besar Kecamatan Batu Ampar Kabupaten Kubu Raya. BUM Desa Sungai Besar Kecamatan Batu Ampar dibentuk pada tanggal 01 September 2022 berdasarkan Sertifikat Pendaftaran Pendirian Badan Hukum Kementerian Hukum dan Hak Asasi Manusia RI Nomor: AHU-06962.AH.01.33 Tahun 2022 dengan nama "Mekar Lestari". BUM Desa "Mekar Lestari" Sungai Besar Kecamatan Batu Ampar diatur melalui Peraturan Desa Sungai Besar Nomor 2 Tahun 2022 tentang Pendirian Badan Usaha Milik Desa dan Peraturan Kepala Desa Sungai Besar Nomor 1 Tahun 2022 tentang Anggaran Rumah Tangga Badan Usaha Milik Desa Sungai Besar Mekar Lestari. BUM Desa "Mekar Lestari" Sungai Besar Kecamatan Batu Ampar mendapat penyertaan modal awal dari Pemerintah Desa Sungai Besar pada tahun 2023 sebesar Rp. 50.000.000,00 (Lima puluh juta rupiah). Penyertaan modal yang diperoleh BUM Desa "Mekar Lestari" Sungai Besar dipergunakan untuk kegiatan usaha dalam menampung hasil kopra masyarakat, penyediaan BBM solar untuk nelayan, dan menampung hasil laut nelayan, seperti udang, ikan dan cumi-cumi sebagaimana tercantum dalam Lampiran Peraturan Desa Sungai Besar Nomor 2 Tahun 2022 tentang Pendirian Badan Usaha Milik Desa. Namun faktanya, BUM Desa "Mekar Lestari" Sungai Besar Kecamatan Batu Ampar Kabupaten Kubu Raya belum melaksanakan kegiatan usahanya sebagaimana tercantum dalam Lampiran Peraturan Desa Sungai Besar Nomor 2 Tahun 2022 tentang Pendirian Badan Usaha Milik Desa sampai saat ini. Faktor penyebab BUM Desa Mekar Lestari Sungai Besar Kecamatan Batu Ampar belum melaksanakan kegiatan usahanya dikarenakan nilai jual kopra saat ini mengalami penurunan yang cukup signifikan, dimana harga kopra sekarang yang dijual kepada penampung paling mahal per kilonya hanya Rp. 4.500,00 (empat ribu lima ratus rupiah), sedangkan pada tahun 2022 harga kopra per kilo mencapai Rp. 8.000,00 (delapan ribu rupiah). Begitu pula dengan nilai jual hasil laut seperti ikan, udang dan cumi-cumi mengalami kenaikan akibat naiknya harga Bahan Bakar Minyak (BBM), sehingga BUM Desa Mekar Lestari Sungai Besar tidak mampu untuk menampung hasil laut nelayan. Kemudian penyediaan BBM solar untuk nelayan sudah diusahakan oleh BUM Desa Mekar Lestari Sungai Besar, namun masih menunggu izin rekomendasi dari Bupati Kubu Raya yang sampai sekarang belum terbit, sehingga penyediaan BBM solar untuk nelayan belum bisa direalisasikan. Upaya yang dilakukan oleh Badan Usaha Milik Desa (BUM Desa) Mekar Lestari Sungai Besar Kecamatan Batu Ampar Kabupaten Kubu Raya untuk melaksanakan kegiatan usahanya adalah tetap melaksanakan kegiatan usaha sesuai dengan Anggaran Dasar BUM Desa Mekar Lestari Sungai Besar Kecamatan Batu Ampar seperti menjual pestisida yang dibutuhkan oleh petani, walaupun dengan modal yang dianggap minim. Selain itu, BUM Desa Mekar Lestari Sungai Besar Kecamatan Batu Ampar meminta penambahan penyertaan modal kepada Pemerintah Desa Sungai Besar Kecamatan Batu Ampar agar dapat melaksanakan kegiatan usahanya secara maksimal.
