Abstract The outsourcing system imposed on workers causes problems because workers do not get legal protection and their rights. One of the rights of outsourced workers who do not receive legal protection is the absence of an increase in worker status in the career path because outsourced workers will not be appointed as permanent workers. This also happened to Aviation Security (Avsec) outsourcing workers at Pontianak Supadio Airport, where Avsec outsourcing workers at Pontianak Supadio Airport were recruited by PT. Angkasa Pura Solusi which is a subsidiary of PT. Angkasa Pura II (Persero) with a Certain Time Work Agreement (PKWT). In fact, Avsec outsourced workers at Pontianak's Supadio Airport do not get legal protection. The formulation of the problem in this study is: "What Factors Cause Aviation Security (AVSEC) Outsourcing Workers at Pontianak Supadio Airport Not to Get Legal Protection in accordance with the Provisions of Government Regulation Number 35 of 2021 concerning Certain Time Work Agreements, Outsourcing, Working Time and Rest Time, and Termination of Employment ?". While the purpose of the study is to reveal the factors causing Aviation Security (Avsec) outsourcing workers at Pontianak Supadio Airport have not received legal protection in PKWT based on Government Regulation Number 35 of 2021, legal consequences for PT. Angkasa Pura Solutions and efforts that can be made by Aviation Security (Avsec) outsourcing workers at Pontianak Supadio Airport to get legal protection in PKWT based on Government Regulation Number 35 of 2021. The legal research method used by the author is an empirical legal research method with a descriptive research nature. Based on the results of the study, it was concluded that the factors causing AVSEC outsourced workers at Pontianak Supadio Airport have not received legal protection in PKWT to be appointed as permanent workers based on Government Regulation Number 35 of 2021 concerning Certain Time Work Agreements, Outsourcing, Working Time and Rest Time, and Termination of Employment due to PT. Angkasa Pura Solusi is only an outsourcing service provider company. Meanwhile, the factor causing AVSEC outsourced workers at Pontianak Supadio Airport has not received legal protection in obtaining compensation money because the PKWT does not include compensation money after the end of the work period. Legal consequences of PT. Angkasa Pura Solutions that do not provide legal protection for AVSEC outsourcing workers at Pontianak Supadio Airport can be prosecuted and subject to compensation sanctions based on Government Regulation Number 35 of 2021. Efforts that can be made by AVSEC outsourcing workers at Pontianak Supadio Airport to obtain legal protection in PKWT based on Government Regulation Number 35 of 2021 are by non-litigation means, namely conducting consultations with the Vice President of Human Resources Development of PT. Angkasa Pura Solusi to get legal protection for their rights to be appointed as permanent workers. In addition, asking for compensation money after the end of PKWT every year that is not paid by PT. Angkasa Pura Solutions. If Vice President of Human Resources Development PT. Angkasa Pura Solusi does not want to give their rights, so AVSEC outsourcing workers at Pontianak Supadio Airport can report to the Office of Investment, Manpower and One-Stop Integrated Services Pontianak City. Meanwhile, thelitigation that can be done by AVSEC outsourced workers at Pontianak Supadio Airport to get legal protection is to file a lawsuit against the law to the Industrial Relations Court. Abstrak Sistem outsourcing yang diberlakukan terhadap pekerja menimbulkan permasalahan karena pekerja tidak mendapatkan perlindungan hukum dan hak-haknya. Salah satu hak pekerja outsourcing yang tidak mendapat perlindungan hukum adalah tidak adanya peningkatan status pekerja dalam jenjang karir karena pekerja outsourcing tidak akan diangkat sebagai pekerja tetap. Hal ini juga terjadi pada pekerja outsourcing Aviation Security (Avsec) di Bandara Supadio Pontianak, dimana pekerja outsourcing Avsec di Bandara Supadio Pontianak direkrut oleh PT. Angkasa Pura Solusi yang merupakan anak perusahaan dari PT. Angkasa Pura II (Persero) dengan Perjanjian Kerja Waktu Tertentu (PKWT). Faktanya, pekerja outsourcing Avsec di Bandara Supadio Pontianak tidak mendapatkan perlindungan hukum.Rumusan masalah dalam penelitian ini adalah: "Faktor Apa Yang Menyebabkan Pekerja Outsourcing Aviation Security (AVSEC) di Bandara Supadio Pontianak Tidak Mendapatkan Perlindungan Hukum Sesuai Ketentuan Peraturan Pemerintah Nomor 35 Tahun 2021 Tentang Perjanjian Kerja Waktu Tertentu, Alih Daya, Waktu Kerja dan Waktu Istirahat, dan Pemutusan Hubungan Kerja ?". Sedangkan tujuan penelitian adalah untuk mengungkapkan faktor penyebab pekerja outsourcing Aviation Security (Avsec) di Bandara Supadio Pontianak belum mendapatkan perlindungan hukum dalam PKWT berdasarkan Peraturan Pemerintah Nomor 35 Tahun 2021, akibat hukum bagi pengusaha PT. Angkasa Pura Solusi dan upaya yang dapat dilakukan oleh pekerja outsourcing Aviation Security (Avsec) di Bandara Supadio Pontianak untuk mendapatkan perlindungan hukum dalam PKWT berdasarkan Peraturan Pemerintah Nomor 35 Tahun 2021. Metode penelitian hukum yang digunakan penulis adalah metode penelitian hukum empiris dengan sifat penelitian deskriptif.Berdasarkan hasil penelitian, maka diperoleh kesimpulan bahwa faktor penyebab pekerja outsourcing AVSEC di Bandara Supadio Pontianak belum mendapatkan perlindungan hukum dalam PKWT untuk diangkat sebagai pekerja tetap berdasarkan Peraturan Pemerintah Nomor 35 Tahun 2021 Tentang Perjanjian Kerja Waktu Tertentu, Alih Daya, Waktu Kerja dan Waktu Istirahat, dan Pemutusan Hubungan Kerja dikarenakan PT. Angkasa Pura Solusi hanya sebagai perusahaan penyedia jasa outsourcing. Sedangkan faktor penyebab pekerja outsourcing AVSEC di Bandara Supadio Pontianak belum mendapatkan perlindungan hukum dalam memperoleh uang kompensasi karena di dalam PKWT tidak mencantumkan adanya uang kompensasi setelah berakhirnya masa kerja. Akibat hukum bagi PT. Angkasa Pura Solusi yang tidak memberikan perlindungan hukum terhadap pekerja outsourcing AVSEC di Bandara Supadio Pontianak adalah dapat dituntut dan dikenakan sanksi ganti kerugian berdasarkan Peraturan Pemerintah Nomor 35 Tahun 2021. Upaya yang dapat dilakukan pekerja outsourcing AVSEC di Bandara Supadio Pontianak untuk mendapatkan perlindungan hukum dalam PKWT berdasarkan Peraturan Pemerintah Nomor 35 Tahun 2021 adalah dengan cara non litigasi yaitu melakukan musyawarah dengan Vice President of Human Resources Development PT. Angkasa Pura Solusi untuk mendapat perlindungan hukum akan hak-hak mereka agar diangkat sebagai pekerja tetap. Di samping itu, meminta uang kompensasi setelah berakhirnya PKWT setiap tahun yang tidak dibayar oleh PT. Angkasa Pura Solusi. Apabila Vice President of Human Resources Development PT. Angkasa Pura Solusi tidak mau memberikan hak-hak mereka, maka pekerja outsourcing AVSEC di Bandara Supadio Pontianak dapat melaporkan ke Dinas Penanaman Modal, Tenaga Kerja dan Pelayanan Terpadu Satu Pintu Kota Pontianak. Sedangkan upaya litigasi yang dapat dilakukan pekerja outsourcing AVSEC di Bandara Supadio Pontianak untuk mendapatkan perlindungan hukum adalah dengan mengajukan gugatan perbuatan melawan hukum ke Pengadilan Hubungan Industrial.
