<![CDATA[Abstrac Currently, many criminal settlements are carried out with a restorative justice approach both at the police, prosecutor's office and court levels. Indonesia as a country that adheres to a civil law legal system that prioritizes positive law in its law enforcement process. This certainly shows positive things related to law enforcement in Indonesia, especially in cases of theft committed by children in the district of Landak. However, in the practice of implementing restorative justice, there are negative effects for children as perpetrators of theft crimes in Landak District.Such as the lack of deterrent effect on children as perpetrators of theft. Another influence is in the form of criminal repetition and encouraging criminal actors (intellectual actors) to utilize children to become perpetrators of criminal acts with promised rewards.Therefore, it is necessary to affirm the children who are litigated in the process of implementing diversion which is intended as the best solution for children.The type of research used by the author in compiling this research is sociological legal research, and is usually called field research, by examining positive legal provisions and the reality that occurs in the community.Keywords: Restorative Justice, Theft, Children, Legal System Abstrak Saat ini banyak penyelesaian tindak pidana yang dilakukan dengan pendekatan restorative justice baik di tingkat kepolisian, kejaksaan maupun pengadilan. Indonesia sebagai negara yang menganut sistem hukum civil law yang mengedepankan hukum positif dalam proses penegakkan hukumnya. Hal ini tentu menunjukkan hal positif terkait penegakkan hukum di indonesia terutama dalam kasus pencurian yang dilakukan oleh anak di kabupaten landak. Namun, dalam praktik penerapan restorative justice terdapat pengaruh negatif bagi anak sebagai pelaku tindak pidana pencurian di kabupaten landak.Seperti kurangnya efek jera pada anak sebagai pelaku tindak pidana pencurian. Pengaruh lainnya berupa terjadi pengulangan pidana serta mendorong pelaku pidana (aktor intelektual) memanfaatkan anak untuk menjadi pelaku tindak pidana dengan dijanjikan imbalan.Maka dari itu diperlukan penegasan terhadap anak yang berperkara dalam proses pelaksanaan diversi yang ditujukan sebagai penyelesaian terbaik bagi anak. Jenis penelitian yang digunakan penulis dalam menyusun penelitian ini adalah penelitan hukum sosiologis, dan biasanya disebut dengan penelitian lapangan, dengan cara mengkaji ketentuan hukum positif dan kenyataan yang terjadi di lingkungan masyarakat.Kata Kunci: Restorative Justice, Pencurian, Anak, Sistem Hukum]]>
