DAMPAK PENGHAPUSAN KOMISI APARATUR SIPIL NEGARA TERHADAP PENGAWASAN NETRALITAS APARATUR SIPIL NEGARA

ABSTRAK Penelitian ini bertujuan untuk mengkaji dampak penghapusan Komisi Aparatur Sipil Negara terhadap pengawasan netralitas Aparatur Sipil Negara, kemudian untuk mengkaji bagaimana pengawasan netralitas ASN pada penyelenggaraan Pilkada Provinsi Kalimantan Barat tahun 2024 pasca penghapusan KASN. Penelitian juga berfokus pada penyelenggaraan Pemilihan Kepala Daerah Provinsi Kalimantan Barat Tahun 2024. Jenis penelitian ini adalah penelitian hukum Normatif. penelitian ini bersifat yuridis dokmatik bertujuan untuk menjelaskan hasil penelitian dari permasalahan yang diteliti dalam bentuk pemaparan yang terperinci. Penghapusan KASN berpotensi berdampak terhadap pengawasan netralitas ASN, seperti mengurangi efektivitas pengawasan terhadap netralitas ASN mengingat KASN selama ini berperan sebagai lembaga yang mengatur dan mengawasi pelaksanaan netralitas ASN dalam politik. Pasca penghapusan KASN, tugas pokok dan fungsi pengawasan netralitas ASN kini telah beralih ke Kementerian Pendayagunaan Aparatur Negara dan Reformasi Birokrasii (KEMENPANRB) dan Badan Kepegawaian Negara (BKN). Upaya preventif (pencegahan) dilakukan guna berfokus pada pencegahan sebelum masalah itu terjadi, dalam konteks ini tujuannya adalah mencegah pelanggaran netralitas ASN. Upaya preventif yang dapat dilakukan adalah dengan cara melakukan sosialisasi kepada ASN terkait pentingnya netralitas ASN. Upaya pengawasan terhadap ASN tentunya terus dilakukan, khususnya terkait netralitas ASN. Whistleblowing system merupakan mekanisme penyampaian pengaduan terkait adanya dugaan pelanggaran, tindak pidana, atau tindakan lain yang melanggaran ketentuan yang berlaku, yang dilakukan oleh pegawai dilingkungan unit tempat kerjanya atau wilayah lain.Kata Kunci: Penghapusan Komisi Aparatur Sipil Negara, Pengawasan Netralitas ASN.   ABSTRACT    This research aims to examine the impact of the abolition of the State Civil Apparatus Commission on monitoring the neutrality of the State Civil Apparatus, then to examine how the neutrality of ASN will be monitored in the implementation of the West Kalimantan Province Regional Election in 2024 after the abolition of KASN. The research also focuses on the implementation of the 2024 West Kalimantan Province Regional Head Election. This type of research is Normative legal research. This research is of a docmatic juridical nature and aims to explain the research results of the problems studied in the form of a detailed presentation. The abolition of KASN has the potential to have an impact on monitoring ASN neutrality, such as reducing the effectiveness of monitoring ASN neutrality considering that KASN has been acting as an institution that regulates and supervises the implementation of ASN neutrality in politics. After the abolition of KASN, the main tasks and functions of monitoring the neutrality of ASN have now shifted to the Ministry of State Apparatus Empowerment and Bureaucratic Reform (KEMENPANRB) and the State Civil Service Agency (BKN). Preventive efforts are carried out to focus on prevention before the problem occurs, in this context the aim is to prevent violations of ASN neutrality. Preventive efforts that can be taken are by conducting outreach to ASN regarding the importance of ASN neutrality. Efforts to monitor ASN will of course continue to be carried out, especially regarding ASN neutrality. The whistleblowing system is a mechanism for submitting complaints regarding alleged violations, criminal acts, or other actions that violate applicable regulations, carried out by employees within their work unit or other areas.Keywords: Abolition of the National Civil Service Commission, Oversight of ASN Neutrality.
