<![CDATA[Abstrac From Article 5 of the Minister of Transportation Regulation Number 45 of 2020 concerning Certain Vehicles Using Electric Motor Drives, that on Jalan Jenderal Ahmad Yani Pontianak they do not allow electric bicycle riders to ride their vehicles on the sidewalk and also on the sidewalk there is a bicycle lane which in Article 5 Regulation of the Minister of Transportation Number 45 of 2020 concerning Certain Vehicles Using Electric Motor Drives regulates the places that have been provided and these places are bicycle lanes and sidewalks on Jalan Jenderal Ahmad Yani Pontianak. But in reality, electric bicycles are prohibited from being ridden in these areas which are considered inadequate. To avoid violations so that people do not ride electric bicycles in this area, notice boards have been installed so that people do not violate these rules.So the author formulates the problem as follows: "How is Article 5 of the Minister of Transportation Regulation Number 45 of 2020 implemented regarding certain vehicles using electric motor drives?" In this research, the type of research used is normative legal research. Normative legal research is a legal research method that examines document studies using various secondary data such as statutory regulations, court decisions, and can be the opinions of scholars.So the author can draw the conclusion that the supervision carried out by the authorized institutions in the field of traffic and road transportation, especially in this research, namely the Pontianak City Transportation Service and Pontianak City Traffic Police, especially on Jalan Jendral Ahmad Yani Pontianak, regarding the use of electric bicycles is still lacking because only in the form of a warning, there is no firm action from the authorized institution and the effectiveness of the legal provisions for the use of electric bicycles, especially in article 3 and article 4 of the Minister of Transportation Regulation Number 45 of 2020 concerning Certain Vehicles Using Electric Motor Drives is still less effective. This happens because Minister of Transportation Regulation Number 45 of 2020 concerning Certain Vehicles Using Electric Motor Drives does not regulate sanctions if electric bicycle users do not comply with the provisions. Therefore, the regional government needs to follow up regarding making more concrete regulations regarding the problem of electric bicycles in Pontianak City.Keywords: Electric bicycles, traffic, ministerial regulations Abstrak Dari Pasal 5 Peraturan Menteri Perhubungan Nomor 45 Tahun 2020 tentang Kendaraan Tertentu dengan Menggunakan Penggerak Motor Listrik, bahwa di jalan Jenderal Ahmad Yani Pontianak tidak mengizinkan pengedara sepeda listrik mengendarai kendaraan yang dikendarainya di atas trotoar dan juga di trotoar tersebut terdapat jalur sepeda yang dimana pada Pasal 5 Peraturan Menteri Perhubungan Nomor 45 Tahun 2020 tentang Kendaraan Tertentu dengan Menggunakan Penggerak Motor Listrik mengatur tempat yang telah disediakan dan tempat tersebut adalah jalur sepeda dan trotoar yang ada di Jalan Jenderal Ahmad Yani Pontianak. Tetapi kenyataanya sepeda listrik dilarang dikendarai di area tersebut yang dianggap kurang memadai. Untuk menghindari pelanggaran agar masyarakat tidak mengendarai sepeda listrik diarea tersebut maka dipasang papan pengumuman agar masyarakat tidak melanggar aturan tersebut.Maka penulis merumuskan permasalahan sebagai berikut: "Bagaimana Implementasi Pasal 5 Peraturan Menteri Perhubungan Nomor 45 Tahun 2020 tentang Kendaraan tertentu dengan Menggunakan Penggerak Motor Listrik?". Dalam penelitian ini, jenis penelitian yang digunakan adalah penelitian hukum normatif. Penelitian hukum normatif adalah suatu metode penelitian hukum yang mengkaji studi dokumen menggunakan berbagai data sekunder seperti peraturan perundang-undangan, keputusan pengadilan, dan dapat berupa pendapat para sarjana.Maka penulis dapat menarik kesimpulan bahwa Pengawasan yang dilakukan oleh lembaga yang berwenang di bidang lalu lintas dan angkutan jalan khususnya dalam penelitian ini adalah lembaga Dinas Perhubungan Kota Pontianak dan Polisi Lalu Lintas Kota Pontianak khususnya di Jalan Jendral Ahmad Yani Pontianak terhadap penggunaan sepeda listrik masih kurang karena hanya berupa teguran tidak ada tindakan yang tegas dari lembaga yang berwenang dan efektivitas dari ketentuan hukum penggunaan sepeda listrik khususnya dalam pasal 3 dan pasal 4 Peraturan Menteri Perhubungan Nomor 45 Tahun 2020 tentang Kendaraan Tertentu dengan Menggunakan Penggerak Motor Listrik masih kurang efektif. Hal ini terjadi karena Peraturan Menteri Perhubungan Nomor 45 Tahun 2020 tentang Kendaraan Tertentu dengan Menggunakan Penggerak Motor Listrik tidak mengatur sanksi apabila pengguna sepeda listrik tidak sesuai dengan ketentuan. Maka dari itu pemerintah daerah perlu menindaklanjuti terkait pembuatan aturan yang lebih konkret tentang permasalahan sepeda listrik di Kota Pontianak.Kata Kunci : Sepeda Listrik, Lalu Lintas, Peraturan Menteri]]>
