Abstract

This study examines the application and limitations of employer liability for unlawful acts committed by subordinates under Article 1367 of the Indonesian Civil Code from the perspective of vicarious liability, focusing on the South Jakarta District Court Decision Number 237/Pdt.G/2022/PN Jkt.Sel. The research is motivated by the ambiguity of the phrase “in the course of assigned duties,” which has led to multiple interpretations and legal uncertainty in judicial practice. This study employs a normative juridical method using statutory, conceptual, and case approaches. The findings reveal that employer liability cannot be narrowly determined solely by the existence of a formal employment relationship or compliance with standard operating procedures, but must be assessed functionally based on delegated authority, inherent occupational risks, and the effectiveness of supervision grounded in good corporate governance principles. The analyzed decision demonstrates an expanded interpretation of Article 1367 of the Civil Code, whereby failures in supervision justify imposing liability on the employer even when the subordinate’s acts exceed formal authority. The novelty of this study lies in formulating criteria for limiting employer liability by integrating the doctrine of vicarious liability, delegation theory, and corporate governance principles as evaluative instruments. This study recommends the enactment of explicit legislation defining the boundaries of employer liability to ensure legal certainty and substantive justice.   Penelitian ini menganalisis penerapan dan batasan pertanggungjawaban majikan atas perbuatan melawan hukum bawahan berdasarkan Pasal 1367 Kitab Undang-Undang Hukum Perdata dalam perspektif vicarious liability, dengan studi kasus Putusan Pengadilan Negeri Jakarta Selatan Nomor 237/Pdt.G/2022/PN Jkt.Sel. Penelitian ini dilatarbelakangi oleh ketidakjelasan frasa “dalam menjalankan pekerjaan yang ditugaskan” yang menimbulkan multitafsir dan ketidakpastian hukum dalam praktik peradilan. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan kasus. Hasil penelitian menunjukkan bahwa pertanggungjawaban majikan tidak dapat ditentukan secara sempit hanya berdasarkan keberadaan hubungan kerja formal dan kepatuhan terhadap standar operasional prosedur, melainkan harus dinilai secara fungsional melalui keterkaitan kewenangan yang didelegasikan, risiko jabatan, serta efektivitas pengawasan berbasis prinsip good corporate governance. Putusan yang dianalisis menunjukkan adanya perluasan penafsiran terhadap Pasal 1367 KUHPerdata dengan menempatkan kegagalan pengawasan sebagai dasar pembebanan tanggung jawab majikan meskipun perbuatan bawahan dilakukan di luar kewenangan formal. Kebaruan penelitian ini terletak pada perumusan kriteria batas pertanggungjawaban majikan yang mengintegrasikan doktrin vicarious liability, teori pendelegasian, dan prinsip tata kelola perusahaan yang baik sebagai instrumen evaluatif. Penelitian ini merekomendasikan pembentukan regulasi yang secara eksplisit mengatur batasan pertanggungjawaban majikan guna mewujudkan kepastian hukum dan keadilan bagi para pihak.
