Abstract Protection of maternity rights is a crucial aspect of labor law to ensure the welfare of female workers. Although regulations explicitly prohibit the termination of employment for workers who are pregnant, in practice there remains a significant gap between normative legal provisions and their implementation. Pregnant female workers are often placed in a weak bargaining position, resulting in the neglect of their constitutional rights in favor of corporate administrative formalities. This study employs a descriptive-analytical research type using a normative juridical method with a case approach to Decision Number 125/Pdt.Sus-PHI/2021/PN Mdn. Data were collected through library research consisting of primary, secondary, and tertiary legal materials. Qualitative analysis was conducted to examine the judges’ legal considerations and their conformity with labor protection principles applicable in Indonesia. The results indicate that the judges’ legal reasoning in the decision tends to be formalistic, with primary emphasis placed on formal evidence such as fixed-term employment agreements and resignation letters. This condition results in legal protection for pregnant female workers being fulfilled only normatively while failing substantively. The judges overlooked indications of coercion in the resignation process, thereby preventing the achievement of optimal justice for female workers who experienced termination of employment during pregnancy. Keywords: worker, pregnant, termination, employment, relationship Abstrak Perlindungan terhadap hak maternitas merupakan aspek krusial dalam hukum ketenagakerjaan guna menjamin kesejahteraan pekerja perempuan. Meskipun regulasi secara tegas melarang Pemutusan Hubungan Kerja (PHK) terhadap pekerja yang sedang dalam keadaan hamil, namun pada praktiknya masih terdapat kesenjangan yang signifikan antara aturan normatif dengan implementasi di lapangan. Seringkali, pekerja perempuan hamil berada dalam posisi tawar yang rendah, sehingga hak-hak konstitusional mereka terabaikan demi kepentingan formalitas administratif perusahaan. Penelitian ini menggunakan jenis penelitian deskriptif analitis dengan metode penelitian yuridis normatif melalui pendekatan kasus (case approach) terhadap Putusan Nomor 125/Pdt.Sus-PHI/2021/PN Mdn. Data dikumpulkan melalui data kepustakaan yang bersumber dari bahan hukum primer, sekunder, dan tersier. Analisis data dilakukan secara kualitatif untuk memahami pertimbangan hukum hakim serta kesesuaiannya dengan prinsip-prinsip perlindungan tenaga kerja yang berlaku di Indonesia. Hasil penelitian menunjukkan bahwa pertimbangan hukum hakim dalam putusan tersebut cenderung bersifat formalistik, di mana fokus utama lebih dititikberatkan pada bukti formal seperti Perjanjian Kerja Waktu Tertentu (PKWT) dan surat pengunduran diri. Hal ini mengakibatkan perlindungan hukum terhadap pekerja perempuan hamil hanya terpenuhi secara normatif namun gagal secara substantif. Hakim mengabaikan fakta adanya tekanan dalam pengunduran diri tersebut, sehingga keadilan bagi pekerja perempuan yang mengalami PHK saat hamil tidak tercapai secara optimal.
