<![CDATA[ABSTRAK Perkembangan teknologi digital telah memudahkan masyarakat dalam mengakses komik, yang mana kini tersedia dalam bentuk digital salah satunya manhwa yaitu komik asal Korea Selatan. Namun, kemudahan akses ini diiringi dengan maraknya situs ilegal yang menerjemahkan dan mengunggah manhwa tanpa izin pencipta melalui metode scanlation yang telah melanggar hak moral dan hak ekonomi yang dimiliki oleh pencipta. Berdasarkan hal tersebut, rumusan masalah dalam penelitian ini adalah: (1) bagaimakah upaya perlindungan hukum terhadap pencipta komik digital manhwa yang karyanya diunggah pada situs ilegal di Indonesia? dan (2) apakah faktor pendorong seseorang membaca komik digital pada situs ilegal? Penelitian ini bertujuan untuk mengetahui dan menganalisis kedua permasalahan tersebut secara menyeluruh. Penelitian ini menggunakan metode hukum normatif yang bersifat deskriptif dengan pendekatan yuridis normatif melalui studi kepustakaan dan penelitian lapangan. Data diperoleh dari data sekunder dan survei dengan teknik purposive sampling, kemudian dianalisis secara kualitatif menggunakan metode deskriptif. Hasil penelitian menunjukkan bahwa pengunggahan dan penerjemahan manhwa melanggar Pasal 5 ayat (1) dan Pasal 9 ayat (1) huruf b, c, e dan h Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta yang dapat dituntut menggunakan Pasal 113 ayat (4) Undang-Undang Nomor 28 Tahun 2014 dan pencipta dapat juga memohon penutupan atau penghapusan situs ilegal menggunakan Peraturan Bersama MenkumHAM dan MenKomInfo No. 14 Tahun 2015/ No. 26 2015. Sesuai dengan asas nasional treatment dalam Hak Cipta, pencipta manhwa dapat menggunakan peraturan Hak Cipta yang berlaku di Indonesia untuk melindungi dan menegakan haknya yang dilanggar di Indonesia. Namun penegakan hukum terhadap pelanggaran digital seperti scanlation masih belum optimal akibat lemahnya pengawasan dan pemblokiran yang hanya menyasar domain situs. Berdasarkan hasil analisis survei pada penelitian ini, menujukan bahwa faktor utama pembaca lebih memilih membaca pada situs ilegal ialah karena gratis, mudah diakses dan update lebih cepat. Kata kunci: Hak Cipta, Manhwa, Situs Ilegal, Perlindungan Hukum, Pembajakan Digital ABSTRACT The development of digital technology has made it easier for people to access comics, which are now available in digital form, one of which is manhwa, a comic from South Korea. However, this ease of access is accompanied by the proliferation of illegal websites that translate and upload manhwa without the creator's permission through scanlation methods that violate the moral and economic rights of the creator. Based on this, the research questions in this study are: (1) What are the legal protection efforts for creators of digital manhwa comics whose works are uploaded on illegal websites in Indonesia? and (2) What are the factors that drive people to read digital comics on illegal websites? This study aims to identify and analyze these two issues comprehensively. This study uses a descriptive normative legal method with a normative juridical approach through literature study and field research. Data was obtained from secondary data and surveys using purposive sampling techniques, then analyzed qualitatively using descriptive methods. The results of the study indicate that the uploading and translation of manhwa violate Article 5 paragraph (1) and Article 9 paragraph (1) letters b, c, e, and h of Law Number 28 of 2014 concerning Copyright, which can be prosecuted using Article 113 paragraph (4) of Law No. 28 of 2014, and creators may also request the closure or removal of illegal websites using Joint Regulation of the Minister of Law and Human Rights and the Minister of Communication and Information Technology No. 14 of 2015/No. 26 of 2015. In accordance with the national treatment principle in copyright law, manhwa creators can use the copyright regulations applicable in Indonesia to protect and enforce their rights that have been violated in Indonesia. However, law enforcement against digital violations such as scanlation is still not optimal due to weak supervision and blocking that only targets website domains. Based on the results of the survey analysis in this study, it shows that the main factors why readers prefer to read on illegal websites are because they are free, easily accessible, and updated more quickly.
