Abstract

The escalating divorce rate in Indonesia, particularly among couples in early marriage (zero to five years), necessitates preventive interventions aligned with Islamic legal principles to preserve family integrity (hifdzun nasl). Marriage Guidance (Bimwin) conducted by the Office of Religious Affairs (KUA) represents state intervention to establish harmonious families (sakinah mawaddah warahmah). This study analyzes Bimwin implementation from an Islamic law perspective and its effectiveness in internalizing marital values. Employing qualitative library research methodology, data were analyzed descriptively-analytically referring to Islamic legal sources (Quran, Hadith, Fiqh Munakahat) and Indonesian regulations. Findings indicate that Bimwin conceptually aligns with Sadd adz-Dzari'ah principle (blocking paths to corruption), where premarital guidance prevents divorce prohibited by Allah. Guidance materials encompassing spousal rights and obligations, conflict management, and family resilience embody Mu'asyarah bil Ma'ruf (harmonious cohabitation). Under Islamic law, Bimwin constitutes a crucial instrument ensuring fulfillment of spiritual marriage requirements to achieve Maqashid Sharia objectives. The transformation from voluntary to mandatory policy since 2024, requiring certification as administrative prerequisite for marriage registration, demonstrates strengthened legal standing. However, enhancement requires integration of contemporary Islamic jurisprudence values more adaptive to modern social challenges for effectively minimizing divorce rates through multisectoral collaboration involving health institutions and family planning agencies.
