Abstract

Abstract:Asas retroaktif dan lex posterior derogat legi priori merupakan prinsip fundamental dalam penerapan hukum pidana Indonesia yang memerlukan perhatian khusus, terutama dalam konteks perubahan undang-undang. Penelitian ini menganalisis aspek yuridis penjatuhan sanksi terhadap pelaku tindak pidana penambangan pasir ilegal melalui studi kasus Putusan No.556/Pid.Sus/2020/PN Kpn. Menggunakan metode penelitian hukum normatif dengan pendekatan studi kasus, penelitian ini mengkaji dua permasalahan utama: pengaturan tindak pidana penambangan pasir ilegal dalam hukum pidana Indonesia dan dasar pertimbangan hakim dalam menggunakan UU No. 4 Tahun 2009 tentang Mineral dan Batubara pada putusan tersebut. Hasil penelitian menunjukkan bahwa regulasi penambangan pasir ilegal diatur dalam beberapa instrumen hukum yang saling berkaitan, yaitu UU No. 4 Tahun 2009 tentang Mineral dan Batubara, UU No. 3 Tahun 2020 sebagai perubahannya, dan Perda No. 1 Tahun 2005 tentang pengendalian usaha pertambangan di Jawa Timur. Pada putusannya, majelis hakim menerapkan UU No. 4 Tahun 2009 dengan pertimbangan asas retroaktif, mengingat tindak pidana terjadi sebelum berlakunya UU No. 3 Tahun 2020. Penerapan asas ini sejalan dengan prinsip perlindungan hak terdakwa sebagaimana diatur dalam Pasal 1 ayat (2) KUHP. Studi ini memberikan kontribusi penting bagi pemahaman penerapan hukum pidana dalam kasus penambangan ilegal, khususnya terkait asas retroaktif dan pertimbangan hakim dalam menentukan dasar hukum yang digunakan.Kata Kunci: Asas retroaktif, UU Minerba, tambang pasir ilegalAbstract: The principles of retroactivity and lex posterior derogat legi priori are fundamental principles in the application of Indonesian criminal law that require special attention, especially in the context of changes to the law. This research analyses the juridical aspects of imposing sanctions on perpetrators of illegal sand mining through a case study of Decision No.556/Pid.Sus/2020/PN Kpn. Using a normative legal research method with a case study approach, this research examines two main issues: the regulation of the criminal offence of illegal sand mining in Indonesian criminal law and the judge's reasoning in using Law No. 4/2009 on Minerals and Coal in the decision. The results showed that the regulation of illegal sand mining is regulated in several interrelated legal instruments, namely Law No. 4/2009 on Minerals and Coal, Law No. 3/2020 as an amendment, and Regional Regulation No. 1/2005 on mining business control in East Java. In its decision, the panel of judges applied Law No. 4 of 2009 with consideration of the retroactive principle, considering that the criminal offence occurred before the enactment of Law No. 3 of 2020. The application of this principle is in line with the principle of protecting the rights of the defendant as stipulated in Article 1 paragraph (2) of the Criminal Code. This study makes an important contribution to the understanding of the application of criminal law in illegal mining cases, especially regarding the principle of retroactivity and the judge's consideration in determining the legal basis used.Keyword: Retroactive principle, Minerba Law, illegal sand mining
