PERAMPASAN ASET TANPA PEMIDANAAN (KOMPARASI NEGARA INDONESIA DAN AUSTRALIA)

Abstract

Artikel ini menganalisis bagaimana pengaturan perampasan aset dengan mengkomparasi antara  negara Australia dan Indonesia dengan peraturan perampasan aset yang di terapkan di negara Australia, dan peraturan perampasan aset yang di terapkan di Indonesia serta melihat keunggulan dari peraturan tersebut juka di terapkan di Indonesia. Penelitian ini merupakan penulisan hukum normatif yang bersifat preskriptif dan terapan dengan pendekatan yang digunakan, yaitu pendekatan perbandingan (comperative approach) dan pendekatan perundang-undangan (statue approach). Penulisan hukum ini bersumber pada bahan hukum primer dan bahan hukum sekunder menggunakan teknik pengumpulan bahan hukum studi kepustakaan dengan teknik analisis silogisme bersifat deduksi. Tujuan dari penulisan artikel ini untuk mengetahui bahwa sistem hukum di Indonesia sudah meratifikasi perampasan aset tanpa pemidanaan, tetapi Indonesia belum mempunyai Undang-Undang tentang perampasan aset tanpa pemidanaan. Berbeda halnya dengan Australia yang sudah menerapkan peraturan perampasan aset tanpa pemidanaan tersebut dan australia berhasil dalam meminimalisir korupsi dinegaranya.Abstract: This article analyzes how the asset forfeiture regulation is compared between Australia and Indonesia with the asset forfeiture regulations applied in Australia, and the asset forfeiture regulations applied in Indonesia and looks at the advantages of these regulations when applied in Indonesia. This research is a prescriptive and applied normative law writing with the approach used, namely the comparative approach and the statue approach. This legal writing is sourced from primary legal materials and secondary legal materials using the technique of collecting legal materials from literature studies with deductive sillology analysis techniques. The purpose of writing this article is to find out that the legal system in Indonesia has ratified asset forfeiture without criminalization, but Indonesia does not yet have a law on asset forfeiture without criminalization. It is different from Australia which has implemented the law on asset forfeiture without criminalization and Australia has succeeded in minimizing corruption in its country.Keywords: Asset Forfeiture;Non-Conviction; Comparison; Regulations; Indonesia and Australia
