Abstrak. Modernisasi sosial telah mengubah fungsi ekonomi istri dalam keluarga, sehingga memunculkan persoalan hukum mengenai kewajiban nafkah suami, kepemilikan harta istri, serta hak dan kewajiban suami istri. Penelitian ini bertujuan untuk melakukan perbandingan terhadap pengaturan nafkah suami serta pengakuan atas harta milik istri dalam hukum perkawinan di Indonesia dan Malaysia. Metode yang digunakan dalam artikel ini adalah penelitian hukum normatif dengan pendekatan komparatif. Pendekatan komparatif dipilih untuk mengetahui persamaan dan perbedaan sistem hukum di kedua negara sehingga dapat ditemukan konsep hukum yang lebih adil dan relevan dengan perkembangan konteks masyarakat. Temuan artikel ini menunjukkan bahwa perbedaan utama kedua negara terletak pada pengakuan terhadap kontribusi ekonomi istri. Hukum perkawinan Indonesia masih menempatkan kewajiban nafkah sebagai tanggung jawab penuh suami tanpa mekanisme normatif yang secara eksplisit mengakomodasi kontribusi finansial maupun domestik istri dalam pembagian harta bersama. Sebaliknya, hukum keluarga Islam di Malaysia melalui konsep harta sepencarian memberikan pengakuan terhadap kontribusi langsung maupun tidak langsung istri sebagai dasar pembagian harta secara proporsional. Temuan ini menunjukkan bahwa pendekatan Malaysia lebih adaptif terhadap dinamika keluarga modern dan dapat menjadi rujukan dalam pembaruan hukum perkawinan di Indonesia. Abstract. Social modernization has transformed the economic role of wives within the family, giving rise to legal issues concerning the husband's maintenance obligation, the wife's property rights, and the spouses' respective rights and obligations. This study aims to compare provisions regarding spousal support and the recognition of a wife’s property ownership in the marriage laws of Indonesia and Malaysia. This study employs a normative legal research method with a comparative approach. The comparative approach is essential to identify similarities and differences between the legal systems of both countries, thereby fostering laws that are more just and contextually appropriate. The findings of this article indicate that the main difference between the two countries lies in the recognition of wives’ economic contributions. Indonesian marriage law still places the obligation to provide financial support entirely on the husband, without any normative mechanisms that explicitly accommodate the wife’s financial or domestic contributions in the division of joint property. In contrast, Islamic family law in Malaysia, through the concept of harta sepencarian, recognizes the wife’s direct and indirect contributions as the basis for the proportional division of assets. These findings suggest that Malaysia’s approach is more adaptable to the dynamics of modern families and could serve as a reference for the reform of marriage law in Indonesia.
