Abstract

Penelitian ini bertujuan untuk menganalisis penanganan tindak pidana korupsi di bidang pengadaan barang dan jasa oleh Kejaksaan Tinggi Sulawesi Selatan, serta mengidentifikasi berbagai kendala yang dihadapi dalam proses penanganannya. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan peraturan perundang-undangan dan studi kepustakaan. Hasil penelitian menunjukkan bahwa penanganan perkara korupsi oleh Kejaksaan Tinggi Sulawesi Selatan masih belum konsisten dan belum optimal. Hal ini tercermin dari meningkatnya jumlah kasus korupsi pada Tahun 2023–2024, serta banyaknya perkara dari tahun-tahun sebelumnya yang belum terselesaikan atau mengalami stagnasi. Kondisi ini memerlukan perhatian serius, khususnya dalam penguatan langkah-langkah preventif guna meminimalkan potensi kerugian negara. Adapun kendala utama yang dihadapi antara lain: kurangnya kooperasi dari saksi dalam memberikan keterangan secara jujur dan lengkap, hambatan dalam pelacakan serta penyitaan aset hasil tindak pidana korupsi untuk dijadikan barang bukti maupun pemulihan kerugian negara, lamanya proses audit kerugian negara oleh auditor, serta adanya indikasi intervensi dalam proses hukum. Diperlukan upaya sistemik dan koordinasi lintas sektor untuk meningkatkan efektivitas pemberantasan korupsi, khususnya dalam sektor pengadaan barang dan jasa. This study aims to analyze the handling of corruption in the procurement of goods and services by the South Sulawesi High Prosecutor's Office, and to identify various obstacles faced in the handling process. The method used is normative legal research with a statutory regulatory approach and literature study. The results of the study indicate that the handling of corruption cases by the South Sulawesi High Prosecutor's Office is still inconsistent and suboptimal. This is reflected in the increasing number of corruption cases in 2023–2024, as well as the many cases from previous years that have not been resolved or have stagnated. This condition requires serious attention, especially in strengthening preventive measures to minimize potential state losses. The main obstacles faced include: lack of cooperation from witnesses in providing honest and complete statements, obstacles in tracking and confiscating assets resulting from corruption to be used as evidence or for recovering state losses, the length of the state loss audit process by auditors, and indications of intervention in the legal process. Systematic efforts and cross-sector coordination are needed to increase the effectiveness of eradicating corruption, especially in the procurement of goods and services sector.
