Abstract

Penelitian ini bertujuan untuk menganalisis Putusan Nomor: 106/Pid.Sus-TPK/2023/PN.Mks yang menyatakan terdakwa lepas dari segala tuntutan hukum dalam perkara tindak pidana korupsi, serta menggali pertimbangan hukum yang digunakan oleh Majelis Hakim dalam menjatuhkan putusan tersebut. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, pendekatan kasus, dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa meskipun terdakwa terbukti secara formil melakukan perbuatan yang didakwakan dalam dakwaan subsidiair, tidak ditemukan unsur mens rea berupa niat jahat atau itikad untuk memperkaya diri sendiri maupun orang lain. Perbuatan terdakwa lebih tepat dikualifikasikan sebagai kelalaian administratif yang berkaitan dengan pengawasan proyek pembangunan gedung perpustakaan, yang sebagian besar telah terealisasi. Putusan lepas ini didasarkan pada pertimbangan yuridis bahwa unsur korupsi tidak terpenuhi secara substantif, serta pertimbangan filosofis yang mengedepankan keadilan substantif dan proporsionalitas sanksi. Dari sisi sosiologis, hakim mempertimbangkan kontribusi terdakwa sebagai pejabat publik dan dampak sosial dari pemidanaan yang tidak sebanding dengan tingkat kesalahan yang terjadi. Putusan ini mencerminkan pendekatan hukum yang adaptif terhadap konteks sosial, serta mengedepankan prinsip keadilan restoratif dan praduga tak bersalah dalam sistem peradilan pidana. This study aims to analyze Decision Number: 106/Pid.Sus-TPK/2023/PN.Mks which states that the defendant is acquitted of all legal charges in a corruption case, and to explore the legal considerations used by the Panel of Judges in making the decision. This study uses a normative legal method with a statutory approach, a case approach, and a conceptual approach. The results of the study indicate that although the defendant was formally proven to have committed the act charged in the subsidiary indictment, no elements of mens rea were found in the form of malicious intent or intention to enrich oneself or others. The defendant's actions are more appropriately qualified as administrative negligence related to the supervision of the library building construction project, most of which have been realized. This acquittal decision is based on legal considerations that the elements of corruption are not substantively fulfilled, as well as philosophical considerations that prioritize substantive justice and proportionality of sanctions. From a sociological perspective, the judge considered the defendant's contribution as a public official and the social impact of the punishment that was not comparable to the level of error that occurred. This decision reflects an adaptive legal approach to the social context, and promotes the principles of restorative justice and the presumption of innocence in the criminal justice system.
