PENGHENTIAN PENYIDIKAN PERKARA MELALUI KEADILAN RESTORATIVE JUSTICE DI POLRES WAJO

Abstract

Penelitian ini bertujuan untuk menganalisis praktik penghentian perkara pidana dengan restoratif serta mengidentifikasi kendala yang dihadapi aparat kepolisian dan masyarakat. Metode yang digunakan adalah penelitian kualitatif dengan pendekatan yuridis empiris, melalui studi pustaka, observasi, serta wawancara dengan penyidik dan pihak terkait. Analisis dilakukan menggunakan teori keadilan restoratif dan teori efektivitas hukum. Hasil penelitian menunjukkan bahwa penerapan restorative justice di Polres Wajo masih terbatas oleh beberapa faktor: rendahnya pemahaman korban terhadap legitimasi perdamaian informal, konflik antara norma adat dan hukum formal, minimnya sarana prasarana mediasi, kurangnya pelatihan penyidik, serta lemahnya pengawasan dan dokumentasi administratif. Akibatnya, efektivitas kebijakan restorative justice belum optimal. This study aims to analyze the practice of stopping criminal cases with restorative and identify obstacles faced by police officers and the community. The method used is qualitative research with an empirical juridical approach, through literature studies, observations, and interviews with investigators and related parties. The analysis was carried out using restorative justice theory and legal effectiveness theory. The results of the study show that the implementation of restorative justice in the Wajo Police is still limited by several factors: low victim's understanding of the legitimacy of informal peace, conflicts between customary norms and formal law, lack of mediation infrastructure, lack of investigator training, and weak supervision and administrative documentation. As a result, the effectiveness of restorative justice policies has not been optimal.
