Penelitian ini bertujuan menganalisis bentuk pertanggungjawaban pidana militer terhadap pelaku desersi serta pertimbangan hukum hakim dalam Putusan Nomor 12-K/PM III-16/AD/III/2025. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan pendekatan kasus. Analisis data dilakukan secara kualitatif berdasarkan bahan hukum primer dan sekunder. Hasil penelitian menunjukkan bahwa pertanggungjawaban pidana terhadap pelaku desersi diwujudkan melalui pidana penjara selama satu tahun dan pemecatan dari dinas militer. Terdakwa terbukti melakukan ketidakhadiran tanpa izin selama 40 hari berturut-turut pada waktu damai sehingga memenuhi unsur Pasal 87 ayat (1) ke-2 juncto ayat (2) KUHPM. Pertimbangan hakim didasarkan pada aspek yuridis berupa pemenuhan unsur tindak pidana desersi dan ketentuan pemeriksaan in absentia, serta aspek non-yuridis berupa disiplin, loyalitas, dan kepentingan institusi TNI. Putusan tersebut mencerminkan penerapan hukum yang bertujuan menjaga disiplin prajurit dan kepastian hukum dalam lingkungan peradilan militer. This study aims to analyze the form of military criminal liability for desertion offenders and the judge’s legal considerations in Decision Number 12-K/PM III-16/AD/III/2025. This research employs a normative juridical method using statutory and case approaches. The data were analyzed qualitatively based on primary and secondary legal materials. The results indicate that military criminal liability for desertion was imposed in the form of one year imprisonment and dismissal from military service. The defendant was proven to have been absent without official permission for 40 consecutive days during peacetime, thereby fulfilling the elements of Article 87 paragraph (1) point 2 in conjunction with paragraph (2) of the Indonesian Military Criminal Code. The judge’s considerations were based on juridical aspects, including the fulfillment of the elements of the offense and the application of in absentia proceedings, as well as non-juridical aspects such as military discipline, loyalty, and the interests of the Indonesian National Armed Forces (TNI). The decision reflects the enforcement of military law aimed at maintaining discipline among military personnel and ensuring legal certainty within the military justice system.
