Penelitian ini membahas proses penyidikan kecelakaan lalu lintas yang disebabkan oleh anak di bawah umur di wilayah hukum Polresta Banjarmasin. Penelitian menggunakan metode penelitian hukum empiris, yaitu peneliti meneliti langsung objek penelitian di Unit Lakalantas Polresta Banjarmasin. Penelitian ini bertujuan untuk mengetahui proses penyidikan kecelakaan lalu lintas yang disebabkan oleh anak serta hambatan dalam proses penyidikan tersebut dan cara tim penyidik mengatasinya. Berdasarkan hasil penelitian, dalam proses penyidikan kecelakaan lalu lintas yang pelakunya anak terdapat delapan tahap, yaitu mendatangi tempat kejadian perkara, koordinasi penyidik dengan kanit lantas, keluarnya SPDP, gelar perkara, pelaksanaan visum, pelaksanaan diversi, kesepakatan diversi, serta keputusan diversi dan penyampaiannya ke kejaksaan. Diversi diupayakan sesuai dengan Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak Pasal 6. Dalam proses penyidikan ini ditemui hambatan berupa saksi yang cenderung sulit ditemukan, karena saksi dapat berasal dari pengguna jalan yang hanya melintas, sedangkan warga sekitar enggan memberikan kesaksian karena takut ketika dimintai keterangan oleh penyidik. Hambatan tersebut dapat diatasi penyidik dengan cara memberikan pemahaman kepada masyarakat yang berada di tempat kejadian perkara bahwa kesaksian mereka merupakan unsur penting untuk melanjutkan proses penyidikan. ABSTRACT This study discusses the investigation process of traffic accidents caused by minors within the jurisdiction of Polresta Banjarmasin. It employs an empirical legal research method, in which the researcher directly examined the research object at the Traffic Accident Unit of Polresta Banjarmasin. This study aims to determine the investigation process of traffic accidents caused by children, the obstacles encountered during the investigation, and how the investigators overcome them. The findings show that the investigation process for accidents committed by children consists of eight stages, namely visiting the crime scene, coordination between investigators and the traffic unit head, issuance of the SPDP, case exposure, conducting the post-mortem, implementing diversion, reaching a diversion agreement, and the diversion decision and its submission to the prosecutor. Diversion is pursued in accordance with Article 6 of Law Number 11 of 2012 concerning the Juvenile Criminal Justice System. The main obstacle is the difficulty in finding witnesses, as witnesses may be road users who merely pass by, while nearby residents are reluctant to testify out of fear. This obstacle is overcome by making the public at the crime scene understand that their testimony is an essential element for continuing the investigation.
