KEDUDUKAN KPK DALAM STRUKTUR KETATANEGARAAN INDONESIA DAN IMPLIKASINYA TERHADAP KEPOLISIAN DAN KEJAKSAAN

Kajian ini membahas Kedudukan KPK dalam Struktur Ketatanegaraan Indonesia dan Implikasinya terhadap Kepolisian dan Kejaksaan. Revisi Undang-Undang No. 30 Tahun 2002 telah mengubah status KPK yang semula tidak masuk kedalam rumpun kekuasaan manapun menjadi masuk dalam rumpun kekuasaan eksekuif. Pendekatan yang digunakan dalam penelitian ini adalah yuridis normatif. Pendekatan dilakukan dengan mengedepankan interpretasi hukum dan telaah mengenai konsep lembaga antikorupsi yang ideal yang bersifat teoritis menyangkut doktrin, asas-asas dan norma hukum yang menyangkut lembaga negara penunjang yang bersifat independen. Penelitian ini bersifat deskriptif analitis yang menggambarkan serta menyimpulkan permasalahan menjadi objek penelitian. Lembaga antikorupsi diidealkan memiliki independensi secara konstitusional dan personal. Keberadaan penyidik kepolisian dan kejaksaan yang bertugas di KPK telah menimbulkan conflict of interest menjadi dasar pemikiran untuk memperkuat penyidik KPK yang berasal dari internal KPK itu sendiri (penyidik independen). This study discusses the position of the KPK in the Indonesian Administrative Structure and its implications for the Police and Prosecutors'. Revision of Law Number 30 of 2002 has changed the status of the KPK which previously did not enter into any power clusters into the executive power clusters.The approach used in this research is normative juridical. The approach is carried out by prioritizing the interpretation of the law and the study of the ideal concept of anti-corruption institutions which are theoretical concerning doctrines, principles and legal norms concerning supporting independent state institutions. This research is analytical descriptive which describes and concludes the problem to be the object of research. The institution of corruption is supposed to have constitutional and personal independence. The existence of police investigators and prosecutors on duty at the KPK has led to conflicts of interest being the rationale for strengthening KPK investigators who originate from the KPK itself (independent investigators).
