This study examines the constitutional implications of vacancies in the Regional People’s Representative Council (DPRD) following the separation of national and local elections. The projected vacancies after the 2029 term require a legitimate transitional mechanism. Using normative legal research with statutory, conceptual, and historical approaches, the study finds that term extensions, interim replacements (PAW), and by-elections face significant constitutional and practical limitations. As an alternative, it proposes establishing a Provisional Regional People’s Representative Council (DPRDS). By maintaining the legislative composition from the previous election, the DPRDS preserves local governance continuity while upholding democratic legitimacy and constitutional principles.
