Abstrak. Artikel ini bertujuan menganalisis faktor-faktor yang menyebabkan tingginya permohonan dispensasi perkawinan di Pengadilan Agama Kabupaten Malang pada tahun 2024 serta mengkaji implikasinya dalam perspektif perlindungan hukum anak. Metode yang digunakan adalah penelitian kualitatif dengan pendekatan normatif yuridis. Data diperoleh melalui wawancara dengan hakim Pengadilan Agama Kabupaten Malang serta didukung oleh laporan tahunan pengadilan, peraturan perundang-undangan, dan dokumen terkait dispensasi perkawinan. Hasil penelitian menunjukkan bahwa kehamilan di luar nikah merupakan faktor dominan yang melatarbelakangi tingginya permohonan dispensasi perkawinan, di samping faktor pergaulan bebas, budaya, dan kondisi sosial keluarga. Dalam mengabulkan permohonan dispensasi, hakim mendasarkan pertimbangannya pada ketentuan Undang-Undang Nomor 16 Tahun 2019, Peraturan Mahkamah Agung Nomor 5 Tahun 2019, serta prinsip kepentingan terbaik bagi anak dengan memperhatikan aspek psikologis, kesehatan reproduksi, dan kemaslahatan. Meskipun pemberian dispensasi memberikan kepastian hukum bagi para pihak, praktik tersebut tetap berpotensi menimbulkan konsekuensi terhadap pemenuhan hak anak, terutama dalam aspek pendidikan, kesehatan, dan kesiapan mental, sehingga diperlukan upaya pencegahan perkawinan anak secara lebih komprehensif. Abstract. This article aims to analyze the factors contributing to the high number of marriage dispensation applications at the Malang Regency Religious Court in 2024 and to examine their implications from the perspective of child legal protection. The study employs a qualitative method with a normative-juridical approach. Data were obtained through interviews with judges at the Malang Regency Religious Court and supplemented by annual court reports, legislation, and documents related to marriage dispensations. The findings indicate that premarital pregnancy is the dominant factor driving the high volume of marriage dispensation applications, alongside factors such as promiscuity, cultural influences, and family social conditions. In granting dispensation requests, judges base their considerations on the provisions of Law Number 16 of 2019 and Supreme Court Regulation Number 5 of 2019, as well as the principle of the best interests of the child, while taking into account psychological aspects, reproductive health, and general well-being. Although granting a dispensation provides legal certainty for the parties involved, the practice still carries potential consequences for the fulfillment of children's rights particularly regarding education, health, and mental readiness thereby necessitating more comprehensive efforts to prevent child marriage.
