Abstract

As this research discusses the optimization of the protection of citizens' constitutional rights through the decisions of the Constitutional Court (MK) in order to realize the supremacy of the constitution in Indonesia. The constitution places citizens' rights as a central part of the rule of law and democracy, while the Constitutional Court (MK) serves as the tester of laws against the 1945 Constitution, the interpreter of the constitution, and the protector of citizens' constitutional rights. The final and binding decisions of the Constitutional Court have far-reaching legal consequences because they apply erga omnes, so laws that contradict the 1945 Constitution can be declared to have no binding legal force. This research uses a normative juridical method with a legislative and conceptual approach. The discussion results show that optimizing the protection of constitutional rights requires strengthening the quality of decision considerations, compliance by lawmakers, consistency in decision implementation, and enhancing citizens' constitutional literacy.
