Patriarchal Paradigm in Land Governance in Indonesia: A Case Study of the Implementation of the PTSL Program in Sinduadi Village

Abstract

The Complete Systematic Land Registration Program (PTSL) aims to provide legal certainty over land ownership for all citizens. Although the policy is formally gender-neutral, its implementation continues to reveal gender disparities in the recognition of women's land rights. This study examines how patriarchal paradigms influence the implementation of the PTSL program in Pogung Lor Village, Sinduadi, Sleman Regency, and identifies the factors contributing to this phenomenon and its impacts on women's legal and economic positions. This research employed a qualitative case study design using a socio-legal approach. Data were collected through observation, semi-structured interviews with 10 informants, consisting offemale PTSL participants, married couples participating in the program, and village officials, complemented by document analysis. Data were analyzed using the Miles and Huberman interactive model through data reduction, data display, conclusion drawing, and source triangulation. The findings indicate that men continue to dominate the stages of socialization, registration, and land certification. Patriarchal practices are reinforced by cultural, structural, historical, economic, and educational factors that restrict women's access to information, participation, and legal recognition of land rights. This study is limited to a single research site; therefore, the findings cannot be generalized to other contexts. The study demonstrates that gender inequality in PTSL is driven more by administrative practices and land governance than by land regulations, providing recommendations for developing more gender-responsive land administration policies.
