<![CDATA[The appointment of Constitutional Court judges is a crucial process in safeguarding the independence and credibility of the constitutional judiciary. The controversy surrounding the appointment of Adies Kadir as a judge of the Constitutional Court has sparked debate regarding the role of the House of Representatives (DPR), particularly in the implementation of the fit and proper test mechanism. The research question in this study is how the DPR exercises its authority in formal terms and whether the substance of the assessment of prospective judges has fulfilled the principles of independence and accountability. The method used is normative legal research employing a legislative approach and conceptual analysis. The research findings indicate that, formally, the DPR has carried out the procedures in accordance with the regulations; however, substantively, there remain weaknesses in terms of transparency, objectivity, and the depth of evaluation regarding the integrity and competence of the candidates. In conclusion, the DPR’s authority in the fit and proper test must not be fulfilled merely procedurally, but must also prioritise the quality of substantive assessment to ensure the selection of Constitutional Court judges who are independent, professional, and of high integrity.]]>
