The Examination Mechanism of Notaries in Criminal Proceedings: Approval of the Notary Honorary Council as an Exception to the Duty of Confidentiality

Abstract

This study discusses the position and function of the Notary Honorary Council in the Indonesian judicial system as well as the problems that arise in its implementation. The main focus of the research is to analyze the position and function of the MKN, the procedure for examining notaries by the Examining Council, the tension between the notary's obligation of confidentiality and criminal provisions, criminal law enforcement against notaries, and the parameters of MKN approval. This normative legal research uses statutory and conceptual approaches with primary and secondary legal materials analyzed qualitatively through grammatical and systematic interpretation. The results of the study indicate that the MKN has a strategic position as a balancing institution between the interests of law enforcement and the protection of the confidentiality of the notary office. The procedure for examining notaries has been regulated in detail, but its implementation faces obstacles related to time limits and approval parameters. The MKN approval parameters, which are cumulative in nature, provide legal certainty but require uniform understanding. This study recommends increasing socialization and improving regulations regarding MKN procedures and parameters.
