Kratom (Mitragyna speciosa) merupakan salah satu komoditas yang diatur ekspornya oleh pemerintah melalui mekanisme perizinan guna menjamin tertib perdagangan dan kepastian hukum. Pengaturan ekspor kratom saat ini diatur dalam Peraturan Menteri Perdagangan Republik Indonesia Nomor 5 Tahun 2026 tentang Perubahan Keempat atas Peraturan Menteri Perdagangan Nomor 23 Tahun 2023 tentang Kebijakan dan Pengaturan Ekspor. Dalam pengaturannya, kratom hanya dapat diekspor dalam bentuk tertentu dengan standar teknis yang ketat, termasuk pembatasan ukuran partikel hingga ≤ 600 mikron serta pemenuhan persyaratan mutu dan perizinan berlapis. Meskipun telah terdapat pengaturan yang cukup rinci, dalam praktiknya masih ditemukan berbagai pelanggaran terhadap ketentuan perizinan ekspor kratom yang menimbulkan implikasi hukum bagi eksportir. Oleh karena itu, penelitian ini bertujuan untuk menganalisis pengaturan dan mekanisme perizinan ekspor kratom di Indonesia dalam perspektif kepastian hukum serta menganalisis kepatuhan eksportir terhadap ketentuan perizinan ekspor kratom beserta implikasi hukum atas pelanggaran yang dilakukan. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan perundang-undangan (statute approach), pendekatan konseptual (conceptual approach), dan pendekatan analitis (analytical approach). Bahan hukum primer terdiri atas Peraturan Menteri Perdagangan Nomor 5 Tahun 2026, Undang-Undang Nomor 7 Tahun 2014 tentang Perdagangan, Undang-Undang Nomor 30 Tahun 2014 tentang Administrasi Pemerintahan, Undang-Undang Nomor 17 Tahun 2006 tentang Kepabeanan, serta putusan pengadilan terkait. Bahan hukum sekunder diperoleh dari buku, jurnal ilmiah, dan penelitian terdahulu. Analisis dilakukan secara kualitatif melalui penafsiran norma hukum yang berlaku. Hasil penelitian menunjukkan bahwa pengaturan dan mekanisme perizinan ekspor kratom telah memberikan kerangka hukum yang relatif jelas melalui pengaturan Eksportir Terdaftar Kratom (ETK), Persetujuan Ekspor (PE), Laporan Surveyor (LS), serta standar teknis mutu produk. Pengaturan tersebut pada dasarnya telah memenuhi unsur kepastian hukum karena memberikan pedoman yang jelas mengenai persyaratan dan prosedur ekspor. Namun demikian, tingkat kepatuhan eksportir masih belum optimal. Hal ini terlihat dari berbagai pelanggaran seperti ketidaksesuaian persyaratan perizinan, penggunaan HS Code yang tidak tepat, ketidaksesuaian dokumen pabean, serta manipulasi informasi barang. Pelanggaran tersebut tercermin dalam Putusan Pengadilan Negeri Jakarta Utara Nomor 421/Pid.Sus/2025/PN Jkt.Utr dan Nomor 422/Pid.Sus/2025/PN Jkt.Utr. Dengan demikian, permasalahan utama dalam ekspor kratom tidak terletak pada ketiadaan regulasi, melainkan pada rendahnya tingkat kepatuhan terhadap ketentuan perizinan yang telah ditetapkan. The export regulation of kratom is currently governed by the Minister of Trade Regulation of the Republic of Indonesia Number 5 of 2026 concerning the Fourth Amendment to Minister of Trade Regulation Number 23 of 2023 on Export Policy and Regulation. Under this regulation, kratom may only be exported in specific processed forms with strict technical standards, including particle size limitation of up to ≤ 600 microns, as well as compliance with quality and multi-layered licensing requirements. Although the regulatory framework is relatively detailed, in practice various violations of kratom export licensing provisions are still found, resulting in legal implications for exporters. Therefore, this study aims to analyze the regulatory framework and licensing mechanism of kratom export in Indonesia from the perspective of legal certainty, as well as to examine exporter compliance with export licensing provisions and the legal implications of such violations. This research is a normative legal study using statutory (statute approach), conceptual (conceptual approach), and analytical (analytical approach) approaches. Primary legal materials consist of Minister of Trade Regulation Number 5 of 2026, Law Number 7 of 2014 on Trade, Law Number 30 of 2014 on Government Administration, Law Number 17 of 2006 on Customs (amending Law Number 10 of 1995), and relevant court decisions. Secondary legal materials are obtained from books, scientific journals, and prior research. The analysis is conducted qualitatively through legal interpretation of applicable norms. The results of the study indicate that the regulatory framework and export licensing mechanism for kratom have provided a relatively clear legal structure through the regulation of Kratom Registered Exporters (ETK), Export Approval (PE), Surveyor Reports (LS), and technical quality standards of the commodity. These regulations generally fulfill the principle of legal certainty by providing clear guidance on export requirements and procedures. However, exporter compliance remains suboptimal. This is reflected in various violations, such as non-fulfillment of licensing requirements, incorrect use of Harmonized System (HS) Codes, discrepancies in customs documentation, and misrepresentation of commodity information. These violations are evidenced in District Court Decision Number 421/Pid.Sus/2025/PN Jkt.Utr and Number 422/Pid.Sus/2025/PN Jkt.Utr. Thus, the main issue in kratom export does not lie in the absence of regulation, but rather in the low level of compliance with existing licensing provisions.
