Reconstructing Islamic Inheritance Law from a Gender Justice Perspective: An Analysis of the Indonesian Compilation of Islamic Law

Abstract

The construction of Islamic inheritance law in Indonesia has remained closely associated with classical jurisprudential principles, particularly the differentiated inheritance shares between male and female heirs under the Compilation of Islamic Law. However, transformations in family structures, women’s economic participation, and the distribution of household responsibilities have raised questions about whether formal inheritance distribution continues to reflect substantive gender justice. This study aimed to reconstruct the conception of justice in Islamic inheritance law within the Compilation of Islamic Law by integrating Islamic legal principles with contemporary socio-economic conditions. Normative legal research was conducted through library research using statutory, conceptual, and Islamic legal approaches. The legal materials were analyzed qualitatively through identification, classification, interpretation, critical analysis, and reconstruction. The results showed that the existing inheritance framework remained strongly influenced by classical jurisprudence, while contemporary family conditions required justice to be evaluated beyond numerical distribution. The study contributed a Contextual-Maqāṣidī Inheritance Justice framework that integrated maqāṣid al-syarī‘ah, maṣlaḥah, gender justice, proportionality, and substantive justice while maintaining the fundamental principles of Islamic Sharī‘ah.
