<![CDATA[Indonesia is a pluralistic nation with highly dynamic religious, ethnic, and social group diversity. On the one hand, this plurality serves as social capital for development; on the other hand, it harbors a latent potential for social conflict if not managed with an inclusive paradigm. This research aims to examine the concept of tasamuh (tolerance) from the perspective of Fiqh Siyasah and its relevance to the constitutional system in Indonesia. Using a descriptive qualitative analysis method with a literature study approach, this research dissects the integration of Islamic values within the framework of positive law. The results of the analysis indicate that the concept of tasamuh aligns directly with the principles of Indonesian constitutional law, particularly in guaranteeing the equality of citizens. The implementation of tasamuh values within the framework of Fiqh Siyasah Dusturiyah proves relevant to the mandate of the 1945 Constitution in maintaining public order and protecting human rights in the public sphere. This research affirms that rational tolerance serves as the foundation for the stability of a civil legal society order in Indonesia.]]>
