Penerapan Restorative Justice Terhadap Pelaku Kekerasan Dalam Rumah Tangga di Pengadilan Militer Dalam Perspektif Korban

Abstract

This study aims to assess the feasibility of applying restorative justice in domestic violence cases in military courts based on the perspective of victims as the main parameter. In practice, the handling of domestic violence by military personnel is not only related to violations of general criminal law, but also to the enforcement of institutional discipline, so that the recovery and protection of victims is often not the main focus. This condition is further complicated by the absence of normative regulations that specifically govern the limits, procedures, and mechanisms for victim protection in the application of restorative justice in the military court system. Therefore, this study is important to critically assess the legitimacy and limits of applying a restorative approach in a hierarchical military legal system. This study uses a normative juridical method with a regulatory, conceptual, and analytical approach to military court decisions. The results show that restorative justice is conceptually relevant to military domestic violence cases, but its substantive feasibility is determined by the fulfillment of victim protection and recovery in the context of institutional power relations. This study concludes that the application of restorative justice can only be considered valid if it guarantees the safety, voluntariness, psychological recovery, and equality of the victim's position. The novelty of this study lies in the assessment of the feasibility of restorative justice in military courts, which systematically uses the victim's perspective as the main normative parameter in determining the limits of its legitimate application.   Penelitian ini bertujuan menilai kelayakan penerapan restorative justice dalam perkara kekerasan dalam rumah tangga (KDRT) di peradilan militer berdasarkan perspektif korban sebagai parameter utama. Dalam praktiknya, penanganan KDRT oleh anggota militer tidak hanya berkaitan dengan pelanggaran hukum pidana umum, tetapi juga dengan penegakan disiplin institusional, sehingga pemulihan dan perlindungan korban sering kali belum menjadi fokus utama. Kondisi ini semakin kompleks karena belum adanya pengaturan normatif yang secara khusus mengatur batas, prosedur, dan mekanisme perlindungan korban dalam penerapan restorative justice di lingkungan peradilan militer. Oleh karena itu, penelitian ini penting untuk menilai secara kritis legitimasi dan batas penerapan pendekatan restoratif dalam sistem hukum militer yang bercorak hierarkis. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan peraturan perundang-undangan, konseptual, dan analisis terhadap putusan pengadilan militer. Hasil penelitian menunjukkan bahwa restorative justice secara konseptual relevan diterapkan dalam perkara KDRT militer, namun kelayakannya secara substantif ditentukan oleh terpenuhinya perlindungan dan pemulihan korban dalam konteks relasi kuasa institusional. Penelitian ini menyimpulkan bahwa penerapan restorative justice hanya dapat dianggap sah apabila menjamin keamanan, kesukarelaan, pemulihan psikologis, dan kesetaraan posisi korban. Kebaruan penelitian ini terletak pada penilaian kelayakan restorative justice di peradilan militer yang secara sistematis menggunakan perspektif korban sebagai parameter normatif utama dalam menentukan batas legitimasi penerapannya.
