Abstract

Modern slavery remains one of the most serious human rights violations occurring massively in the contemporary era. The Global Slavery Index 2023 records more than 1.8 million Indonesians living under conditions of modern slavery, positioning Indonesia among the countries with the highest prevalence in the Asia-Pacific region. Bound by the constitutional mandate of Article 27(2) and Article 28D(2) of the 1945 Constitution, Indonesia is obliged to ensure that its national labor regulations effectively respond to forced labor practices. This study analyzes the harmonization of Indonesia's national labor regulations with the ILO's 11 Indicia of Forced Labour as an effort to prevent modern slavery. The research employs a normative legal method using a statute approach and a comparative approach, examining Law No. 13 of 2003 on Manpower, Law No. 6 of 2023 on Job Creation, and Law No. 18 of 2017 on the Protection of Indonesian Migrant Workers. The findings reveal that harmonization is partial and unsystematic: of the eleven indicators, only Deception and Physical and Sexual Violence have received full adoption, seven indicators are only partially accommodated because existing regulations operate within an administrative-financial dimension without incorporating the element of coercion, while Restriction of Movement and Retention of Identity Documents face a lacuna legis. Consequently, national regulations have yet to function optimally as an instrument protecting workers from modern slavery. Keywords: forced labour; harmonization of law; Indonesian labor law; modern slavery Modern slavery atau perbudakan modern masih berlangsung secara masif di era kontemporer.
