Abstract

This study analyzes the law enforcement of traffic accident offenses in Tanjungpinang, with particular attention to the effectiveness of Articles 310 and 311 of Law Number 22 of 2009 concerning Road Traffic and Transportation in reducing victim fatalities. The study employs a normative-empirical legal approach combining statutory, conceptual, and empirical approaches. Data were obtained through in-depth interviews, document analysis, and literature review, and were analyzed qualitatively using juridical reasoning, data reduction, classification, legal interpretation, and deductive conclusion drawing. The findings indicate that traffic accident cases handled by the Tanjungpinang City Police Traffic Unit are more frequently classified as negligence offenses under Article 310, while Article 311 is applied more selectively because the element of intentional dangerous driving is more difficult to prove. Investigators generally follow established procedures, but face limitations in accident-investigation equipment, CCTV coverage, eyewitness evidence, personnel capacity, and interagency coordination. The study concludes that effective reduction of fatalities requires consistent and evidence-based application of Articles 310 and 311, stronger investigator competence, modern investigation facilities, improved road safety infrastructure, sustained public education, and integrated preventive measures.
