This study aims to analyze the judge’s considerations in imposing imprisonment and rehabilitation on narcotics abusers based on Putusan PN Bintuhan Nomor 57/Pid.Sus/2025/PN Bhn. This issue is significant because Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika emphasizes a rehabilitative approach for narcotics abusers, yet in practice courts frequently impose imprisonment. The research applies normative and empirical juridical methods through the analysis of legislation, court decisions, and field data. The findings indicate that judicial considerations are predominantly based on formal juridical aspects such as evidence and trial facts, while the need for rehabilitation has not become the primary consideration. This study highlights the necessity of strengthening the rehabilitative approach and optimizing integrated assessment mechanisms to ensure justice and legal certainty in narcotics cases.
