Abstract

This study examines the prevention and control of administrative and financial corruption through a comparative analysis of Libyan law and Islamic jurisprudence in light of the objectives of Islamic law (maqāṣid al-sharī‘ah). This study aims to analyze the forms of corruption criminalized under Libyan law, examine the legal and institutional mechanisms established to prevent it, and assess the applicable sanctions, and then compare them with the relevant principles and rulings of Islamic jurisprudence. The study employs normative legal, analytical, and comparative approaches. The study finds that Libyan legislation has established a legal and institutional framework that addresses various forms of corruption, including bribery, embezzlement, unlawful appropriation of public funds, abuse of office, and illicit enrichment, as well as mechanisms for oversight, corruption detection, and asset recovery. Islamic jurisprudence likewise provides a comprehensive framework for addressing corruption by prohibiting bribery, betrayal of trust, unlawful appropriation of wealth, and abuse of authority, while allowing discretionary (ta‘zīr) sanctions based on the nature of the offense, the harm caused, and the public interest. The comparison demonstrates that both systems share fundamental objectives, particularly the protection of wealth, the realization of justice, the prevention of harm, and the protection of the public interest, although they differ in their sources, mechanisms of criminalization and punishment, and institutional procedures.
