This research article aims to examine the importance of law enforcement in the illegal mining sector, focusing on two main values: justice and legal certainty. This research uses a normative juridical method with a statutory and conceptual approach. The data used in the research were obtained through literature studies relevant to the topic under study. The results of the study indicate that there are weaknesses in the licensing system, overlapping authority between agencies, and inconsistencies in the enforcement of criminal and administrative sanctions, resulting in low legal effectiveness in this sector. In addition, there is still non-compliance in the implementation of mining business permits as regulated in the Mineral and Coal Law, where the principle of substantive justice has not been fully addressed in practice. The novelty of this research lies in its reconstructive approach to the paradigm of illegal mining law enforcement, which places the value of substantive justice on a par with formal legal certainty, so that it can become a basis for updating national legal policies in the field of sustainable mining.
