Safe food is a fundamrntal rights of every individual that must be guaranteed by the state. However, the practice of trading food containing hazardous substances is still frequently found and has the potential to endanger public health. This study aims to analyze the criminal liability of business actors who trade food containing hazardous substances based on Decision Number 5492 K/Pid.Sus/2024. This research employs a normative legal research method with a qualitative and descriptive-analytical approach. The results of the study indicate that the criminal liability of business actors is based on the fulfillment of the elements of criminal offense, the existence of fault, the capacity to be held responsible, and the absence of justifying or excusing grounds. In the Decision Number 5492 K/Pid.Sus/2024, the defendant was proven to have been trading food additive containing borax, thereby fulfilling the elements of Article 141 in conjunction with Article 89 of Law Number 18 of 2012 on Food. Accordingly, the imposition of criminal liability upon the defendant is consistent with the provisions of Law Number 18 of 2012 on Food and the principles of geen straf zonder schuld (no punishment without fault) recognized in Indonesian criminal law.
