MAZAHIB Jurnal Pemikiran Hukum Islam (MAZAHIB Journal of Islamic Legal Thoughts, p-ISSN: 1829-9067, e-ISSN: 2460-6588) is a peer-reviewed journal published by the Faculty of Sharia, Samarinda State Institute of Islamic Studies (IAIN Samarinda). Abstract

Corporate Governance is a relatively new issue in the world of business management. Corporate governance is generally associated with the systems and mechanisms that govern relationships and create the right incentives among the parties interested in the company to achieve its business objectives optimally. Good corporate governance generally includes the application of the principles of transparency, accountability, fairness, and responsibility. Implementation of good corporate governance in Islamic financial institutions become increasingly important to do that foster trust within the community and improve the performance and progress of Islamic banking. GCG in the body of Islamic institutions is crucial to the development of Islamic banking towards the more advanced. In principle, the GCG implementation of relevant and in line with Islamic values. Islam requires that every aspect of life regulated by systems and structures that meet the best practices outlined by Allah SWT. Hence these two ideals must go hand in hand. GCG become an integral part of the Islamic concept of a full and thorough.

Abstract

This paper discusses the contextual tradition. Position as the explanatory tradition which al-Qur `an is a source of law for Muslims. As an explanation of al-Qur `an, the hadith of the Prophet would appear appropriate circumstances and background of the lives of the friends who are different, the instructions given by the Prophet any differently. Meanwhile, the friends also interpret the traditions of the Prophet in accordance with their respective capacities, so that the conclusions reached different results. Therefore it is necessary contextual understanding.

Abstract

After the Compilation of Islamic Law, it appears that not only applied Shafi opinion, but wider use other teachings, known as the "replacement heir" and "testament wajibah" that the Sunni doctrine does not exist. Renewal in Islamic inheritance law can be seen also in some other rules. Rules of the father and mother when the heir did not leave a child (which is commonly known in terms gharawain fiqh), the siblings and relatives of the mother when the heir to the state to lose (in terms of fiqh, commonly known by the term Musharaka) and the brothers when with children female. Rules that have made this seem confusing and lead to different interpretations, and caused debate among the 'ulama as well as law enforcement in Indonesia.

Abstract

The hadith that talks about the bank in this study according to the results there takhrij narrated by al-Bukhahri so did Abu Dawud, and the results of research that has been made known that the hadith is authentic quality. Hadith of the banks in this study refers to the concept of Islamic Banking. From here then understood that the modus operandi of the Sharia Bank regardless of usury, because the basic principle of operation is the same kerjasa capital called al-syarikah, and the capital is used to try, then the benefits for the results, "sharing" between the parties banks and customers. Therefore, every Muslim should just make a deal, save money, deposit, and use of existing services to banking institutions, especially in Islamic banks.

Abstract

Fiqhi commentary is an attempt interpretation of legal texts. One interpretation is classified as a work of interpretation is fiqhi Tafsir Al-Munir, the greatest work of Az-Zuhaili Wahbah, a contemporary scholar who has a very broad insight. In the work of this interpretation, legal texts are described in the open, in order that people can understand all the issues at hand. The style and method of use has its own characteristics that distinguish it from other works fiqhi interpretation.

Shari'a banking and conventional banking as financial institutions have many similarities in the quest for profit, but there are some fundamental differences between the two. This paper seeks to review the system of revenue sharing in Shariah banking operations are focused on the study of theology, shari'a finance and operational characteristics that made the difference between shari'a banking with conventional banking.
