Abstract

The research is a qualitative research. The data which is used are primary and sec­ondary data from library and field research. The research aims to analyze the authority of the commercial court to examine and settle commercial case. The definition and means of the other commercial case which have been examined and settled by the commercial court. The result of research shows that the commercial court has carried out the authority since 2001. Besides, commercial cases include trade mark case, patents, copy right and industrial designs. From 2001 up to 2006, four hundreds and seven (407) cases have been examined and settled by the court. The most are trade mark disputes, with two  hundreds and seventy two (272) disputes (91,4%).

Abstract

In developed countries, conflicts between environmental interests and agricultural emissions can not be avoided. Within the legal formal perspective, it is often assumed that all environmental conflicts are solved through the legal-formal system. In reality, however, the conflict between environmental concern and agricultural practices is complicated by wide variety of interests and mere legal formal approaches will not be adequate to solve them. This conflict as it relates to nitrate emissions will be referred to herein as the ‘nitrate conflict’. The role of civil society, in this case the Environmental Non-Governmental Organizations (ENGOs), are often neglected in the nitrate conflict management. This study will document and analyze nitrate con.ict management in the Netherlands and Flanders Belgium, on the roles of ENGOs regarding the issue. Moreover, the research will emphasize the important role of ENGOs in civic engagement in developing democratic and just environmental management.

Abstract

Management of forest plant with partnership pattern was not fair  and did not provide welfare to community. Low education, lack of legal knowledge and less support from government have deprived sense of justice of local community. This research used literary study as main supporting material and field study to collect secondary material to complete this research. Data obtained from literary  and field study was analyzed qualitatively and its result was described to get objective description.
