Abstract

This paper lays out the method of interpretation used by the Indonesian Constitutional Court in inter-preting the articles within 1945 Indonesian Constitution, primarily in judicial reviews and disputes on the authority of state organ. Among the existing and mostly applied interpretation methods injurisprudence, the Court does not consider it self bound by a single method. The resort to variousinterpretation methods,  dependent on the nature of the case at hand, indicates that the Court is progressiveand tends to favour contextual approach. Nonetheless, since the Court is composed of nine differentindividuals, the interpretation approach will largely depend on each Justice’s legal thought. Tulisan ini mencoba menelusuri metode tafsir yang dipergunakan oleh Mahkamah Konstitusi dalam menafsirkan ketentuan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945, terutama dalamperkara pengujian undang-undang dan sengketa kewenangan lembaga negara. Dari beberapa metode tafsiryang ada dan lazim dipergunakan dalam bidang ilmu hukum, ternyata Mahkamah Konstitusi tidak mengikatdirinya pada satu metode tafsir saja. Penggunaan beberapa metode tafsir oleh Mahkamah Konstitusi secarabergantian, tergantung perkara yang dihadapi, menunjukkan sifat progresif dan pemahaman kontekstual.Namun karena Mahkamah Konstitusi adalah kumpulan dari sembilan individu hakim konstitusi makametode tafsir yang dipergunakan sangat tergantung pada kecenderungan dari masing-masing hakim.

Abstract

The infamous complexity of having a proper definition for crime of aggression began a long time ago.  A working definition has been discussed by experts and scholars from time to time. However, they have not reached into a common understanding, including the International Law Commission. The amendment to the Rome Statute, taking place on June 12, 2010, was expected to deal with the problemsof definition. In addition it will also be a guidance to categorize such a crime as a crime of aggression,particular in terms of elaboration of elements of crime of aggression. Kompleksitas pendefinisian kejahatan agresi telah terjadi sejak beberapa tahun yang lalu. Definisi kejahatan agresi telah diperdebatkan oleh para ahli termasuk didalamnya Komisi Hukum Internasional, namun hingga kini perdebatan terus terjadi. Hasil amandemen atas Statuta Roma yang ber-langsung di Kampala Uganda 12 Juni 2010 akan menjadi jalan keluar untuk mengatasi perdebatan dimaksud. Di samping itu, amandemen tersebut dapat menjadi rambu-rambu dalam menguraikan elemen kejahatan agresi, sehingga kejahatan yang diduga sebagai kejahatan agresi dapat diuraikan dengan takaran yang baku (standard) menurut hukum internasional.

Abstract

This article seeks to examine the reasons behind why real estate developers continue to erect housing districts without proper Building Construction Permits. It will also explore the Local Government’s efforts to regulate construction of housing districts and the consumer’s responses in cases where suchdistricts were built without Building Construction Permits. Findings indicate that such practice byreal estate developers occur due to poor oversight and coordination from licensing agencies, complexpermit requirements which frustrates small scale developers, and low legal awareness from developers and consumers. Local Government efforts include oversight by the Integrated Team, requiring lot-based Building Construction Permits, warnings, and sanctions and socializing licensing regulations. Consumersmeanwhile have increasingly become more proactive in demanding their rights from developers andseeking legal advocacy. Penelitian ini bertujuan untuk mengetahui penyebab dari pengembang perumahan membangun  perumahan meskipun belum memiliki IMB, upaya Pemda dalam rangka penertiban pembangunanperumahan, dan upaya konsumen dalam kasus ketiadaan IMB. Hasil penelitian menunjukkan bahwapembangunan perumahan tanpa IMB dilakukan oleh pengembang karena faktor lemahnya pengawasaninstansi perizinan, kurangnya koordinasi antar instansi perizinan terkait, persyaratan yang kompleksdan menyulitkan pengembang berskala kecil, serta kesadaran hukum pengembang dan konsumenmasih rendah. Upaya Pemda berupa pengawasan oleh Tim Terpadu, persyaratan pengajuan IMBperkapling, teguran dan sanksi, serta sosialisasi peraturan perizinan. Konsumen dalam perkembangannyasemakin proaktif memperjuangkan hak-haknya kepada pengembang dan meminta advokasi hukum.

Abstract

Ratification of treaties in Indonesia can be regarded as mere political acts, as ratification itself  does not yet rule for its enforcement in Indonesia’s jurisdiction. As stipulated in Article 11 of the 1945Indonesian Constitution, these ratifications are still subject to consent from the Indonesian House of Representatives (DPR) as they are the appointed institution in Indonesia with treaty-making powers. The act of ratification by the Indonesian Government is regarded as a ratification only in the international sense, where such action would only make the treaty enter into force internationally, but not internally within Indonesia. This paper seeks to analyze the legal implications which signatureand ratification of international treaties may hold in the Indonesian government. Such is done by studying the class action lawsuit for Indonesia being signatories the Convention on the Protection of the Rights of All Migrant Workers and Member of Their Families and its failure continue to further ratify the Convention. Ratifikasi perjanjian internasional merupakan tindakan politik yang memerlukan persetujuan dari  Dewan Perwakilan Rakyat (DPR) sebagai lembaga dengan treaty-making power sebagaimana yangdiatur oleh Pasal 11 UUD 1945. Tindakan ratifikasi oleh Pemerintah Indonesia hanya bermakna sebagairatification hanya dalam the international sense, yakni membuat perjanjian tersebut berlaku di levelinternasional, bukan berlaku di wilayah hukum Republik Indonesia. Artikel ini menganalisis proses andimplikasi hukum diratifikasinya dan ditandatanganinya suatu perjanjian internasional oleh PemerintahIndonesia dengan menelaah gugatan class action yang dilakukan terhadap Pemerintah Indonesia mengenaibelum diratifikasinya Konvensi Buruh Migran.
