Abstract

This article seeks to examine the reasons behind why real estate developers continue to erect housing districts without proper Building Construction Permits. It will also explore the Local Government’s efforts to regulate construction of housing districts and the consumer’s responses in cases where suchdistricts were built without Building Construction Permits. Findings indicate that such practice byreal estate developers occur due to poor oversight and coordination from licensing agencies, complexpermit requirements which frustrates small scale developers, and low legal awareness from developers and consumers. Local Government efforts include oversight by the Integrated Team, requiring lot-based Building Construction Permits, warnings, and sanctions and socializing licensing regulations. Consumersmeanwhile have increasingly become more proactive in demanding their rights from developers andseeking legal advocacy. Penelitian ini bertujuan untuk mengetahui penyebab dari pengembang perumahan membangun  perumahan meskipun belum memiliki IMB, upaya Pemda dalam rangka penertiban pembangunanperumahan, dan upaya konsumen dalam kasus ketiadaan IMB. Hasil penelitian menunjukkan bahwapembangunan perumahan tanpa IMB dilakukan oleh pengembang karena faktor lemahnya pengawasaninstansi perizinan, kurangnya koordinasi antar instansi perizinan terkait, persyaratan yang kompleksdan menyulitkan pengembang berskala kecil, serta kesadaran hukum pengembang dan konsumenmasih rendah. Upaya Pemda berupa pengawasan oleh Tim Terpadu, persyaratan pengajuan IMBperkapling, teguran dan sanksi, serta sosialisasi peraturan perizinan. Konsumen dalam perkembangannyasemakin proaktif memperjuangkan hak-haknya kepada pengembang dan meminta advokasi hukum.

Abstract

This study will discuss the implementation of General Principles of Good Governance (AUPB) in the One Stop Licensing System in the city of Yogyakarta. Some things that would be an important consideration in this study were changes to Local Government Law No. 22 of 1999 as Law No. 32 of 2004 and its consequence, the issuance of Government Regulation No. 84 of 2000 governing the organization’s guidelines in the area of technical authority in issuing permits and Ministerial Decree No. PAN 63/KEP/M.PAN/7/2003 On Implementation Guidelines for Public Service and Administrative Reform Decree No. 26/KEP/M.PAN/2/2004 About Help Technical Transparency and Accountability. Penelitian ini akan membahas penerapan Asas Umum Pemerintahan yang Baik (AUPB) dalam Sistem Perijinan Satu Pintu di Kota Yogyakarta. Beberapa hal yang akan menjadi pertimbangan penting dalam penelitian ini adalah Perubahan UU Otonomi Daerah Nomor 22 Tahun 1999 menjadi UU Nomor 32 Tahun 2004 beserta konsekuensinya. Penerbitan Peraturan Pemerintah Nomor 84 Tahun 2000 yang mengatur tentang pedoman organisasi perangkat daerah dalam kewenangan teknisnya mengeluarkan ijin di daerah serta Kepmen PAN Nomor 63/KEP/M.PAN/7/2003 tentang Pedoman Penyelenggaraan Pelayanan Publik dan Keputusan Menteri Pendayagunaan Aparatur Negara Nomor 26/KEP/M. PAN/2/2004 tentang Petunjuk Teknis Transparansi dan Akuntabilitas.

Abstract

This research explores the evaluation of Arabic language learning by teachers at MDTA Al-Jihad. The study focuses on the teaching methods, challenges faced by the teacher, strategies for motivating students, and initiatives for enhancing students' engagement beyond the classroom. The research was conducted through observations and interviews with Arabic language teacher Najwa Amelia, a 22-year-old graduate in Communication and Islamic Broadcasting from UIN Sumatera Utara.

Abstract

Introduction to the Problem: Under the Indonesian Marriage Law of 1974, the requirement of specific acceptable reasons for divorce underscores the adoption of a fault-based divorce system. However, of the Law also includes “continuous disputes and endless quarrels between the spouses with no hope of reconciliation” as grounds for divorce provided by the Elucidation of Article 39 paragraph (2) letter f, which mirrors the Western no-fault-based divorce concept of irreconcilable differences. This apparent contradiction is intriguing for a comprehensive analysis of which divorce system Indonesia aligns with. Purpose/Study Objectives: This article evaluates the contradiction between Indonesia’s fault-based divorce system and the existence of grounds for divorce, which include “persistent disputes and endless quarrels between the spouses with no hope of reconciliation.” This evaluation aims to confirm whether Indonesia has consistently adhered to the fault-based divorce law system. Design/Methodology/Approach: This article utilizes normative juridical research by examining secondary data as the primary source. The research began with identifying legal principles governing divorce, followed by analyzing the historical development of regulations and legal considerations in judicial decisions. The data were qualitatively analyzed using conceptual, statutory, case-based approaches to provide a critical perspective. Findings: This article reveals that the grounds of “persistent disputes with no hope of reconciliation” first appeared in 1933 under the Indonesian Christian Marriage Ordinance of 1933 under the terminology of onheelbare tweespalt. It was then adopted by the Marriage Law of 1974. Initially, all divorce reasons had to be grounded in the fulfilment of "persistent disputes with no hope of reconciliation," requiring the determination of the party most responsible for the breakdown of the marriage. However, this article concludes that there has been a gradual shift from necessitating identifying fault in "persistent disputes with no hope of reconciliation" to simply recognizing the marriage's breakdown without attributing blame. This ground is now independently sufficient to establish an irreparable breakdown of the marriage. Paper Type: Research Article.

Abstract

Perkembangan peserta didik pada usia 8 tahun (kelas 2 sekolah dasar) merupakan fase penting dalam membentuk kemampuan kognitif, sosial-emosional, bahasa, moral, dan motorik. Pada masa ini, anak berada dalam tahap operasional konkret menurut Piaget, di mana kemampuan berpikir logis mulai berkembang, namun masih berfokus pada hal-hal yang nyata.  Artikel ini membahas karakteristik perkembangan peserta didik usia 8 tahun dengan menyoroti aspek fisik-motorik, kognitif, bahasa, sosial-emosional, dan moral. Kajian teori disusun berdasarkan pandangan beberapa ahli seperti Piaget, Erikson, Gesell, dan Hurlock. Penelitian ini bertujuan memberikan pemahaman komprehensif bagi pendidik agar mampu menyesuaikan strategi pembelajaran sesuai kebutuhan perkembangan anak. Hasil kajian menunjukkan bahwa pemahaman karakteristik perkembangan siswa pada usia ini sangat menentukan efektivitas proses pembelajaran serta pembentukan sikap positif terhadap sekolah.
