Abstract

The age of marriage is always a polemic in the household. This is based on the view that the age of marriage that is not mature mentally, physically, psychologically, and education is susceptible to unstable attitudes in taking policies or decisions. So that it is feared that they have not been able to respond to problems in the marriage. Indonesia is a country with Muslims as a major population regulating the minimum age of marriage, as well as Muslim countries in the world. The research method used is the juridicalnormative approach. There are someconclusions obtained. First, the Shari'a does not explicitly set a minimum age for marriage, but legal age and understanding are elements that must be fulfilled for prospective brides, and especially for husbands who are positioned as heads of families. Second, every Islamic country, including Indonesia, has different rules regarding the minimum age of marriage, but the purpose of the restriction remains the same, which is to form a partner who is physically and resourcefully ready to build a sakinah household.Keywords: Rules; Age; Marriage

Abstract

The implementation ofthe capitalist system has eliminated the Islamic values in economic practice. After the financial crisis hit the world, the capitalist system reaped many questions and its greatnessbegins to be doubted. The capitalist system implementationprecisely creates new problems in the economy. The concept of individualism which is the main key in capitalist practice only creates economic injustice and misery of the poor. The only economic theory that is expected as a light in dealing with economic problems is an economic system that is able to create justice,the welfare of all parties and blessings both the world and the hereafter. The theory is the Islamic economics which in practice is inseparable from Islamiceconomic law. Abstract

Relation between the different of religion comunity in the multicultural nation as in Indonesia be a natural phenomenon that it cannot be avoided. As to one of the problem that had appeared in this case is about wedding problem betweena moslem with the difference religion womans. Majority of the Indonesia religious scholars as scholar in Majelis Tarjih Muhammadiyah had been prohibiting wedding like that with various reason. while a part little of the contemporary moslem scholars have been permiting the wedding. The points which will discussed in this research is how is opinion of Majelis Tarjih Muhammadiyah about the law of wedding with the woman from Ahl Al-Kitab and its ijtihad methodology. This research should analyze the argumentation of the Majelis Tarjih that make forbidding a muslem married with the difference religion womans. This research using library research approach dan content analysis. The results of this research are: (1) Majelis Tarjih of Muhammadiyah forbidding the wedding with sad al-dzari’ah as its argumentation; (2) Majelis Tarjih’s opinion has been irrelevant because two reason, the mistake of methodology and the change of the Indonesian contemporary society (based on an empiric data). Keywords: Ahlu Kitab; Majelis Tarjih; Different Religion Marriage

Abstract

The study on the gradualityprinciple (tadarruj) of Islamic law in the context of Islamic law legislation in Indonesia has broad issues. The process of Islamization in the archipelago has been taking place gradually, since the advent of Islam in the 7th century AD or the first century of the emergence of Islam in Arab. The legislation efforts of Islamic law in the context of the legal system of a country always raises two sides, they are universal and the particular. Universality and particularity of the Islamic laware motivated by two dimensions, ie the dimensions of divinity (ilāhiyyah) and the human dimension (insāniyyah). This paper is a qualitative research that focuses on discussing regarding the implementation of Islamic law at the early spread of Islamin the Indonesianarchipelago, with the historically normative approach. The conclusion is the graduality principle has been applied in the legislative process in the Islamic law in Indonesia,but it has no formal legal basis in the form of laws regulating the formation of a national law, although it has been implemented in the legislation process of Islamic law. Keywords: Islamic law; Graduality; legislation; Indonesian Archipelago

Abstract

Money is the most needed resource by people, becoming a reference for each transaction or individual maneuver and as a medium of exchange.Money is an urgent factor that is useful to boost one's personal power and to control the strategic discourse associating with a political interest and power.The nomination process is often inseparable from the use of money to attract the sympathy of citizens.Supposedly, the candidates should not rely on money politic as a way to win the election, but they must demonstrate their ability to be representative of the people. This research is a qualitative study. It was located in Sangtombolang District, Bolaang Mongondow Regency, North Sulawesi. The data obtained were processed and verified in order to obtain descriptive findings of money politic in the election perspective of Islamic law. The practice of money politic occurred in some people due to ignorance of the law on money politic, habits, and economic urgency. In Islamic values,money politicor risywah is something that is given to cancel the truth and to justify the falsehood,risywah in Islamic law is considered as confiscation of other people's property, as mentioned in Surah Al Baqarah verse 188. MUI also explained that people who give and receive risywah are haram (forbidden). Keywords: Money politic; election; Islamic law

Abstract

This study aimed to determine the degree of understanding of zakat on profession/income and the characteristics of the community distribution model as an effective collection model for zakat institutions. This study used a qualitative method with 68 respondents from various professional work backgrounds including civil servants, teachers, employees, military, police, and government officials. The results of this study were that Jepara people have a high degree of understanding about zakat but have not been fully able to calculate nishab of zakat especially zakat on profession/income. Therefore, not all people who are obliged to pay zakat on professionand the distribution of zakat on professionis still directly to mustahiq.Keywords: Zakat on Profession/Income; Understanding of Zakat; Zakat; Alms
