Abstract

Palm oil waste is the residue produced from the palm oil processing process, which has the potential to cause environmental pollution, and palm oil waste is also one of the main environmental issues in Indonesia that significantly impacts public health and the surrounding ecosystem. Palm oil waste can also cause damage to the environment around the company, therefore, it is essential for the company to take responsibility by ensuring the safety and health of the community living near the company. The purpose of this research is to understand the form of corporate responsibility towards the surrounding community affected by palm oil waste at PT Karya Agung Sawita located in Padang Lawas regency, and to examine the maqashid sharia perspective on the community affected by the company's palm oil waste. The research method used in this research is qualitative with an empirical juridical approach sourced from interviews. The results of this research found that the company's form of responsibility includes waste management into palm oil fertilizer, corporate social responsibility, providing bore wells, providing clean water ponds, compensation and recovery, and internal supervision and sanctions. And the form of corporate responsibility is also not yet fully aligned with maqashid sharia, especially on the points of hifzd nafs (preserving life), hifzd mal (preserving wealth), hifzd nasl (preserving lineage), and hifdz aql (preserving intellect). Therefore, the company can provide benefits to the community if it has fulfilled its responsibilities well, because palm oil waste can cause harm and eliminate dharuriyat al-khamsah if not properly managed, bringing goodness and avoiding harm, which aligns with the objectives of sharia or the goals of maqashid sharia in establishing laws.

Abstract

The use of trademarks or logos is an important aspect in the business world that not only reflects the identity of the company but also constitutes a valuable asset that must be protected. However, currently many businesses or industries are committing violations in the use of trademarks or logos that are already owned by other businesses or industries. This research aims to analyze cases of logo or trademark imitation from the perspective of positive law and the perspective of Fatwa MUI. The research method used in this research is empirical juridical research. The result is, the use of Mie Kacoan brand was declared guilty of imitating the business logo that had similarities in essence with Mie Gacoan, due to the fulfillment of three criteria of similarity, namely in form (visual), pronunciation, and sound. Fatwa MUI Number 1/MUNAS-VII/MUI/5/2005 concerning Intellectual Property Rights (IPR) serves as a guideline for the protection of trademark rights in Islam. Which explains that any form of violation of Intellectual Property Rights (IPR), including but not limited to using, disclosing, creating, using, selling, importing, exporting, distributing, delivering, providing, announcing, reproducing, copying, counterfeiting, and pirating someone else's IPR without permission is considered oppression and is deemed haram. In addition to Fatwa MUI, trademark rights are also protected by Law Number 20 of 2016 concerning Trademarks and Geographical Indications.

Abstract

This research discusses the influence of Aswaja values on the professional ethics of notaries in Indonesia. The professional ethics of notaries, derived from the Greek word "ethos," encompass moral guidelines and social norms applied in the practice of notarial duties. Notaries in Indonesia are expected to perform their duties with integrity, adherence to the law, and in compliance with the code of ethics established by the Indonesian Notaries Association (INI). This code of ethics serves to regulate the behavior of notaries and ensure professionalism and integrity in providing legal services to the community. The methodology used in this rsearch is qualitative with normative legal approach. The results is, the values of Aswaja, upheld by Nahdlatul Ulama (NU), such as tasamuh (tolerance), amar ma’ruf nahi munkar (enjoining what is right and forbidding what is wrong), tawasuth and i'tidal (moderation and justice), and tawazun (balance), are highly relevant in shaping the professional ethics of notaries. These values encourage notaries to act honestly, fairly, and responsibly in carrying out their duties. For example, the value of tasamuh teaches tolerance and mutual respect, which are crucial in the professional and social interactions of notaries. Amar ma’ruf nahi munkar emphasizes the importance of acting rightly and avoiding wrongdoing, which is essential in maintaining the integrity of the profession. Tawasuth, i'tidal, and tawazun, meaning moderation and balance, urge notaries to be fair and prudent in every decision and action they take. By integrating Aswaja values into professional ethics, notaries in Indonesia can enhance the quality of their services, maintain public trust, and ensure the enforcement of fair and dignified laws. This research demonstrates that the application of Aswaja values in the professional ethics of notaries can strengthen integrity and professionalism and contribute to the creation of a better legal environment in Indonesia.
