Abstract

Riba (Usury) has existed since the ignorance period that has been used economically by the capital owners to exploit the poor for benefit. In modern era appears the conventional banking business using the interest system. Observing that it is necessary to analyze the Islamic scholar views regarding to the usury and whether the bank interest is the usury or not. In this regard, all Islamic scholars agree that usury practiced in the classical period is forbidden because there is exploitation elements lead to the tyranny of the capital owners to borrowers. Therefore, the majority of Islamic scholars consider the bank interest identical to the usury. Key words: bank interest, usury, the Islamic law perspective

Abstract

Leaders basically is carrying out the mandate and responsibility, either to those who are lead or to God. Therefore a leader must have character. An ideal leader character has been hinted in the Qur’an with few terms, i.e., the caliph, ulu al-amr, and imam. The Caliph, is meant substitute of Allah position as His representative to prosper the earth, as well as a test for the leader. Since the caliph as a representative of God on the earth, a leader must act wisely. Ulu al-amri, means a person who has authority to regulate and control the situation in accordance with the provisions of Allah. Imam means a people you follow and emulate. Therefore the leadership and the exemplary must be based on faith and piety, knowledge, and success in variety of the exams. Thus the leader character in al-Qur'an perspective is the trustworthy, responsible, wise, and prudent leader, and assess his position as the exam from Allah, so as not to abuse the position and office. Abstract

Hajj obligation is associated with the capability (istitha'ah) to practice it, both physically and property. Istitha'ah concept in the implementation of Hajj seems still not agreed on its definition and boundary by Islamic scholars. Therefore, this istitha'ah requirement is understood differently by the muslim. In one hand, many communities do not care about this istitha'ah requirement. They do everything that they can carrying out one of this Islamic pillars, such as saving, selling or mortgaging valuable property, and Hajj gathering. Even in part willing to owe to others, or take credit to the bank for the sake of realizing his desire to hajj at the Baitullah. On the other hand, the istitha'ah requirement is understood that this Hajj obligation is not too urgent, even if doing the hajj is the Islamic pillar. In this regard using the credit funds from the bank to cost the Hajj could be categorized as the capability. Because it is permissible, and their Hajj worship is legitimate according to some Islamic scholars.
