Abstract

Hajj obligation is associated with the capability (istitha'ah) to practice it, both physically and property. Istitha'ah concept in the implementation of Hajj seems still not agreed on its definition and boundary by Islamic scholars. Therefore, this istitha'ah requirement is understood differently by the muslim. In one hand, many communities do not care about this istitha'ah requirement. They do everything that they can carrying out one of this Islamic pillars, such as saving, selling or mortgaging valuable property, and Hajj gathering. Even in part willing to owe to others, or take credit to the bank for the sake of realizing his desire to hajj at the Baitullah. On the other hand, the istitha'ah requirement is understood that this Hajj obligation is not too urgent, even if doing the hajj is the Islamic pillar. In this regard using the credit funds from the bank to cost the Hajj could be categorized as the capability. Because it is permissible, and their Hajj worship is legitimate according to some Islamic scholars. Key words: Hajj, istita'ah, credit funds

Abstract

The Modus Operandi of Corruption and its Relation to the State Apparatus in the Prophet's Hadiths and Legislation in IndonesiaThis paper aims to explain the modes of corruption and their relation to the state apparatus in the Prophet's traditions and legislation in Indonesia. So far, when many people talk about corruption, their memory is only of the laws that govern it, as if only the laws and regulations regulate corruption. In fact, long before the legislation was made, the Prophet, through his hadiths, have provided clues about corruption. This research is qualitative descriptive using a literature study that relies on library sources in the form of classic books, books, scientific journals, and other literature sources that are considered relevant. This study finds similarities between the Prophet's hadiths and Indonesian legislation in linking corruption (al-gulūl) to the state apparatus ('āmil) and that the modes of corruption are budget fraud, abuse of authority, embezzlement, and gratification and bribe. The mode then increases and develops with the times. Hopefully, through this writing, there will be awareness again that involvement in corruption is not only a violation of laws but also a violation of religious teachings and its legal consequences not only in the world but also in the hereafter.

Abstract

This paper intends to explain the Mardud hadith and the discussion of scholars about its practice. Mardud hadith is a hadith that is rejected to serve as evidence and guidance in life. Even so, there are scholars who are tasahul in applying this provision, especially in cases related to fadail al-a'mal. This research is qualitative descriptive by relying on literature sources. The result of the research shows that all the hadiths of daif are mardud, which should be rejected as evidence in determining the law and refused to be practiced. The accusation that Ahmad bin Hanbal argues that the daif hadith can be practiced in the case of fadail is untrue and has been denied by his followers. The daif hadith he meant was the hasan hadith, which was unknown at that time. Regarding the hadith maudu', it is strictly agreed that it must be rejected, considering that it is a lie in the name of the Prophet and is threatened with hell in the hereafter. It's just that there are many "good sentences" that are spread in society, which are claimed to be the hadith of the Prophet. Some can be proven true, but some others are statements of certain people who are later declared to be from the Prophet. The best attitude towards "good sentences" like this is to examine who the first speaker is, then rely on the sentence on him, because if it is still relying on the Prophet, it will still be punished as maudu‘.

Abstract

Abstract : This research is about the Lawa Safar tradition, a term used by the Morella people to refer to the bath routine on the last Wednesday of Safar month in the Islamic calendar every year. Its aim is to find out its historical roots, analyze it from the aspects of Islamic law, and see the prospects for its development. This descriptive qualitative research relies on literature sources which are strengthened by interviews of ritual actors. From the analysis carried out, it is not certain when Lawa Safar began to be carried out, but as in other places that carry out a similar tradition, the Lawa Safar ritual is influenced by the assumption that Safar is the month of disaster. Lawa Safar is carried out as an effort to repel reinforcements', a prayer to save people from danger and disaster. There is nothing contrary to the teachings of Islam in the series of Lawa Safar rituals, therefore, this tradition can be maintained as one of the syiars of Islam. Moreover, with the status of Morella today as one of the main tourist destinations in Maluku, it is very possible for the Lawa Safar tradition to be developed into one of the annual religious tourism events.Abstrak : Penelitian ini tentang tradisi Lawa Safar,  istilah yang digunakan oleh orang Morella untuk menyebut ritual mandi di Rabu terakhir bulan Safar dalam penanggalan Islam setiap tahun. Tujuan penelitian adalah untuk mengetahui akar sejarahnya, menganalisisnya dari aspek hukum Islam, dan melihat prospek pengembangannya. Tipe penelitian deskriptif kualitatif, data data diperoleh dari  literatur pustaka dan hasil wawancara dari pelaku ritual. Dari analisis yang dilakukan, tidak diketahui dengan pasti kapan Lawa Safar mulai dilaksanakan, tapi seperti halnya di tempat-tempat lain yang melakukan tradisi serupa, ritual Lawa Safar dipengaruhi anggapan bahwa Safar adalah bulan datangnya bencana. Lawa Safar dilakukan sebagai upaya tolak bala’, doa untuk menghindarkan masyarakat dari bahaya dan bencana. Tak ada hal yang bertentangan dengan ajaran Islam dalam rangkaian ritual Lawa Safar, karena itu, tradisi ini dapat dipertahankan sebagai salah satu syiar Islam. Status negeri Morella sekarang sebagai salah satu tujuan utama wisatawan di Maluku, maka tradisi Lawa Safar sangat mungkin dikembangkan menjadi salah satu event wisata religi tahunan.

Abstract

This study intends to explain shudhūdh and the method of understanding it in the hadith matn. It seems that the research on shudhūdh that has been done by scholars and hadith experts focuses more on the hadith sanad, and leaves the discussion of shudhūdh that is in the hadith matn. This research is a qualitative descriptive study by relying on literature sources. From the research conducted, it is found that shudhūdh is actually the causes that make a hadith matn considered odd because it violates other matn which is more numerous or stronger, after comparisons between all the narrations in that hadith. The hadith whose matn is considered odd is called the shādhdh hadith, while the matn hadith which is more numerous is called the hadith maḥfūż. Comparison between narrators in a hadith is known as the muqaranah method, which has been applied to the matn since the time of the companions of the Prophet. As for the shudhūdh that can make the hadith matn awkward is idrāj, which is an insertion from a companion narrator; iqlāb, namely the interchangeability of the position of a word or sentence in matn; ziyādah, namely the addition of words or sentences from thiqah narrators; iḍṭirāb, which is the discovery of several different matnas without being able to decide which one is stronger or weaker; and taḥrīf and taṣḥīf, namely the occurrence of changes in letters or readings in words or sentences in the matn.

Abstract

This study aims to determine whether the text "Demanding Knowledge in Childhood is Like Carving on a Rock", whether it is a hadith of the Prophet. or not and to explain the meaning content of the text which is popular in that society. This determination is important because this text is still being debated about its traditions, it is still found in teaching materials in schools and lecture materials of preachers and preachers on the one hand and the threat of the Prophet. against the perpetrators of lies on behalf of the Prophet. on the other. This research is a qualitative descriptive study that relies on literature sources. The research was carried out by first exploring the hadith books to find the existence of the texts in these books and then testing its hadith by using the theory of authenticity of hadiths built by Ibn al-Salah, that a hadith must meet validity rules, namely continuity. sanad, narrators are 'ādil and dābit and avoid illah and shudhudh. From this test, the conclusion is that the text under study was relying on the Prophet. cannot be accounted for, some of the narrations are not based on the Prophet, but on al-Hasan al-Basri, while the narrations that are based directly on the Prophet. the quality is very low, because the sanad is cut off and the transmitters do not have the characteristic 'adālah. However, this historical text does not mean it contains goodness and needs to be removed from the treasury of Muslims. This text is still a good thing, it can be followed and practiced, as long as it does not rely on the Prophet.

Abstract

Abstract One of the conditions for the validity of a hadith is that it is protected from 'illah. However, what is meant by 'illah in the hadiths and how to know if a hadith contains' illah or not, does not seem to have received much attention from hadith scholars, so the issue of' illah is still being debated among scholars and hadith researchers. This study intends to explain this problem. The research method is literature study using descriptive analysis. From the research conducted, it is known that 'illah does not get as much attention from the scholars of hadith, as it does for the validity of other hadiths. It is also known that the scholars use the word ‘illah’ in the sense of the language, namely something that enters something else, then causes what it enters to change. 'Illah is usually interpreted as a disease, because if the disease enters the body, the body will become weak, the same as' illah if it is entered into a hadith, it will change the quality of the hadith to become weak. The way to find out the existence of 'illah in this hadith is by doing mu'āraḍah, which is the matching of the concepts that are the main content of every hadith object so that the interconnection and harmony between the concepts and other shari'a arguments are maintained, namely with the explicit instructions of the Koran, other traditions, historical knowledge and common sense reasoning. Abstrak salah satu syarat kesahihan suatu hadis adalah bahwa hadis itu terhindar dari ‘illah. Namun apakah yang dimaksud dengan ‘illah pada hadis dan bagiamana cara mengetahui suatu hadis mengandung ‘illah atau tidak, tampaknya belum mendapat perhatian yang besar dari ulama hadis, sehingga masalah ‘illah ini masih terus diperdebatkan di kalangan ulama dan peneliti hadis. Penelitian ini bermaksud menjelaskan masalah tersebut. Metode penelitian bersifat studi kepustakaan dengan menggunakan analisis deskriptif. Dari penelitian yang dilakukan diketahui bahwa ‘illah tidak mendapatkan perhatian yang besar dari para ulama hadis, seperti perhatian pada syarat-syarat kesahihan hadis lainnya. Juga diketahui bahwa para ulama menggunakan kata ‘illah pada pengertian bahasanya, yaitu sesuatu yang masuk kepada sesuatu yang lain, lalu menyebabkan yang dimasukinya itu menjadi berubah. ‘Illah biasa dimaknai sebagai penyakit, karena jika penyakit masuk ke dalam tubuh, maka tubuh akan berubah menjadi lemah sama dengan ‘illah jika masuk ke dalam suatu hadis, maka akan mengubah kualitas dari hadis itu menjadi lemah. Cara untuk mengetahui adanya ‘illah dalam hadis ini adalah dengan melakukan mu‘āraḍah, yaitu pencocokan konsep yang menjadi muatan pokok setiap matan hadis agar tetap terpelihara kebertautan dan keselarasan antarkonsep dengan dalil syariat yang lain, yaitu dengan petunjuk eksplisit al-Quran, hadis yang lain, pengetahuan kesejarahan dan penalaran akal sehat.

Abstract

Nowadays begging has been abused by some people as a profession so that the urge not to give "alms" to beggars on the streets, red lights, and other public places. Even in some places, this appeal will be endeavored to be upgraded to a regional regulation or other legal regulation. Begging in the perspective of the Prophet's hadith is forbidden and only allowed under three conditions, namely those who are in debt to repay their debts, people affected by disasters, such as crop failures, begging to meet their needs, until he has a business that can meet his basic needs, and people who are widely known as very needy people. The Prophet provide solutions so that beggars can try to overcome economic difficulties.Keywords: charity, beggars, hadith of the Holy Prophet, Islamic law.
