Abstract

AbstractAct Number 23 of 2011 concerning the management of zakat is issued with the aim of optimizing the role of BAZNAS in the collection and distribution of zakat, infaq and shodaqoh (ZIS) in the community. However, the community has not fully understood the role of BAZNAS, including in Jember Regency. This study aims to examine the Implementation of Law Number 23 of 2011 concerning zakat maal management in Jember Regency along with its implications and problems by focusing on zakat mal management.This research is a descriptive qualitative research using primary data obtained through observations at the BAZNAS office of Jember Regency. The results of the study show that the management of zakat mall in BAZNAS Jember Regency is still not optimal. BAZNAS in Jember Regency was only established in 2017 so that the majority of people have not understood the importance of zakat management by zakat institutions.This also has implications for the management of zakat mal which is still not optimal. On the other hand, the fundamental problems that occur due to the low trust and understanding of the community towards zakat institutions that play a role in providing services to prospective muzakki to pay zakat mal and facilitate the collection and distribution process.Based on these problems, BAZNAS Jember Regency needs to conduct a massive socialization to the public regarding the role of BAZNAS and the importance of professional zakat management based on the applicable Act. In addition, there also needs to be support from the local government in order to be more optimized for the management of zakat malls in Jember Regency.Keywords: Zakat Mal, BAZNAS of Jember Regency, Act Number 23 Year 2011.

Abstract

This study discusses about how the implementation of the murabahah bil wakalah contract theory on mortgage products in the Bank Syariah Mandiri KC Bojonegoro is seen from the perspective of Sharia Economic Law. The scope of this research is limited to the following issues: (1) How is the implementation of the murabahah contract on mortgage loans in Bank Syariah Mandiri KC Bojonegoro? (2) How is the implementation of the murabahah contract on mortgage loan products in the Bojonegoro KC Mandiri Syariah Bank according to the Sharia Economic Law? This research includes the type of field research. Because this research was conducted at Bank Syariah Mandiri KC Bojonegoro. This research is a qualitative descriptive study because in this study the author will focus the discussion on legal facts in the form of the implementation of financing between banks and customers with murabahah contracts which will then be continued with a comparative analysis of the legal facts referred to as sharia economic law theories. This is intended to test the compatibility between legal theory and the legal practice in question.The results of this research include: (1) The mechanism that must be taken to be able to receive financing for Public Housing Loans from Bank Syariah Mandiri KC Bojonegoro, is carried out through predetermined stages including: (a) submission; (b) BI checking / IDeb (debtor information); (c) the implementation of collateral estimates; (d) determination of ceilings; (e) Imputing data into a computer system; (f) approval of the official for mortgage loans; (g) Issuance of SP3 (Letter of Notification of Financing Approval); (h) Implementation of the contract which is attended by prospective customers, banks and notaries; (i) Disbursement. As for the agreements made between prospective customers and banks, there are elements as follows: (a) Contracting parties; (b) Sighat or iqab qabul akad murabahah; (c) Contract object. The object of the contract referred to in the housing loan product is a new or used house; (d) Nature of contract. Agreements are made clearly, both concerning objects, ceilings, time periods, contract places, financing nominal, margin obtained by the bank, and principal installments. In the event of default or bad credit where the customer is late in paying the installments, the bank's contribution will take the following steps: (a) Intensive billing; (b) Provision of Warning Letters 1, 2 and 3; (c) A restructuring offer (if the customer is pleased), ie installments are adjusted to the customer's ability and large at the end; (d) Voluntary guarantee selling offers; (e) Guaranteed auction. In a condition where the customer is not willing to carry out a contract restructuring, the bank offers that the auction of assets is a guarantee of the akah murabahah. As for the auction, the bank cooperates with a secret auction agency. (2) The implementation of housing loan financing with a murabahah contract in Bank Syariah Mandiri KC Bojonegoro is not in accordance with Sharia Economic Law originating from Law Number 21 of 2008 concerning Islamic Banking, MA Regulation Number 2 of 2008 concerning Compilation of Sharia Economic Law and DSN-MUI fatwa Number 4 of 2000 concerning Murabahah. Keywords: Contract, Murabahah bil Wakalah, KPR, BSM, Sharia Economic Law.

Abstract

This research discusses about the practice of buying and selling sengon plantations with lease agreements carried out by communities in the village of Denok, Lumajang district, Lumajang district. The practice of buying and selling does not appear to be in line with the transaction concepts regulated in Sharia Economic Law. Therefore the author feels interested in the importance of further examining this issue from the perspective of Sharia Economic Law, specifically by using the theory of buying and selling (bai') and rent (ijarah). This research is limited to the following issues: (1) How is the sale and purchase of sengon plantations with ijarah contracts carried out by the people in Denok village, Lumajang district, Lumajang district? (2) What is the implementation of the sale and purchase of sengon plantation with ijarah contract by the people in the village of Denok Lumajang sub-district Lumajang regency according to Sharia Economic Law? And (3) What is the implementation of the sale and purchase of sengon plantations with ijarah contracts by people in the village of Denok Lumajang sub-district Lumajang district according to the principles of Sharia Economic Law? This research is field research where research is conducted by approaching the subject and object of research in the research location. The approach that the author chose in this study is a case study approach, which is an approach used in studies of certain cases from various legal aspects. Data collection techniques that will be selected to obtain accurate data in this study are documentation, observation, and interviews.The results of this research are: (1) The implementation of the buying and selling of sengon plantations with the ijarah contract can be explained by the following points: (a) The type of contract that is said is a lease agreement, although in the contract there are two legal actions, namely buying and selling sengon trees and rental of plantation land (b) Regarding the object of the contract there are two, namely sengon trees and plantation land. For the contract object in the form of sengon tree ownership, the owner moves from the owner to the tenant, while for the contract object in the form of sengon tree does not take ownership, only the right to use temporarily from the owner to the tenant within a specified and agreed period. (c) As a legal consequence of the lease agreement, the owner of the plantation gets an amount of money from the lessee, and the tenant gets a number of sengon plants to be owned (being the owner of sengon) and the right to use the land for the specified time. (2) The sale and purchase of sengon plantations with the ijarah contract in Denok village Lumajang sub-district Lumajang district is in accordance with the theory of akad, bai ’(buying and selling), and ijarah (rent) in Sharia Economic Law. (3) The sale and purchase of sengon plantations with the ijarah contract in Denok village Lumajang sub-district Lumajang district is in accordance with the principles of Sharia Economic Law which includes the principle of permissibility, the principle of benefit, the principle of willingness, the principle of justice, and customary principles as law. Keywords: Sengon, Transaction, Ijarah, Sharia Economic Law.

Abstract

Penelitian ini membahas tentang penerapan akad salam dalam jual beli gabah yang dilakukan oleh masyarakat di desa Balerejo kecamatan Balerejo kabupaten Madiun.  Permasalahan yang hendak diteliti di sini dibatasi dengan beberapa persoalan berikut: (1) Bagaimana penerapan konsep akad salam dalam transaksi jual beli gabah oleh masyarakat desa Balerejo kecamatan Balerejo kabupaten Madiun? (2) Bagaimana tinjauan hukum Islam tentang pelaksanaan akad salam dalam transaksi jual beli gabah?Penelitian ini adalah penelitian lapangan (field research) dimana penelitian dilakukan dengan cara mendatangi subjek dan objek penelitian yang ada di lokasi penelitian. Selain itu penelitian ini juga akan melihat pelaksanaan jual beli gabah dengan akad salam tersebut dari perspektif hukum Islam.Hasil penelitian ini adalah: (1) Dari hasil penemuan penelitian yang penulis lakukan di desa Balerejo, penulis mendapati bahwa transaksi jual beli gabah di lokasi penelitian dapat dikatakan sebagai transaksi jual beli salam karena adanya persamaan-persamaan fundamental dengan konsep akad salam seperti persamaan dalam masalah dasar hukum, akad transaksi, objek akad, pembayaran, dan serah terima objek akad. (2) Pelaksanaan jual beli gabah tersebut juga relevan dan sejalan dengan konsep kemaslahatan dan keadilan apabila ditinjau dari perspektif tujuan-tujuan universal syariah Islam.Kata kunci: Akad, Jual beli, Salam, Gabah, Hukum Islam.

Abstract

The birth of Consumerism Protection Law (UUPK) is meanthas a porpuse to protect consumer in every business activity from many deceitfull whom did by producers and other businessmen. The moslem jurists were admitted that in UUPK have been containing the business ethics substantions that are appropriate with spirit in Islamic teachings. However, as a human law product, UUPK is not loose from some deficits. The deficits will appear clearly when several paragraphs in UUPK compared with philosophical principles in Islamic law. And, this research intended to see how far relevance UUPK towards the maslahat's spirit in Islamic law. Key Word : UUPK, Etika Bisnis Islam, Maslahat.

Abstract

Dalam Tinjauan Hukum Islam akad Muzara’ah idealnya menguntungkan bagi kedua belah pihak, namun yang terjadi di Desa Doho justru sebaliknya, yaitu merugikan salah satu pihak. Penduduk Desa Doho sebagian besar berprofesi sebagai petani, yaitu Penggarap dan Pemilik Lahan dan mempunyai hubungan kerjasama bagi hasil (paroan) atau Muzara’ah. Rumusan Masalah dari Penelitian Tesis ini adalah : Pertama, Bagaimana Pelaksanaan Sistem Muzara’ah di Desa Doho, Kecamatan Dolopo, Kabupaten Madiun. Kedua, Bagaimana tinjauan Hukum Islam terhadap pelaksanaan Sistem Muzara’ah di Desa Doho, Kecamatan Dolopo, Kabupaten Madiun. Penelitian ini menggunakan metode qualitative karena data yang dikumpulkan adalah data realitas sebagaimana adanya. Jenis penelitian ini adalah developmental research, yakni studi deskriptif analisis dengan ragam penelitian kasuistik. Adapun hasil penelitian yang akan dikembangkan dalam penelitian ini adalah penelitian tentang perjanjian Muzara’ah, khususnya antara penggarap dengan pemilik lahan. Obyek penelitian ini adalah petani penggarap dan pemilik lahan di Desa Doho yang melakukan akad Muzara’ah. Teknik pengumpulan data yang akan digunakan dalam penelitian ini adalah observasi dan wawancara. Dari hasil penelitian ini disimpulkan bahwa sistem Muzara’ah yang diterapkan oleh petani di Desa Doho telah sesuai dengan hukum Islam karena pelaksanaan sistem Muzara’ah sepenuhnya diserahkan kepada masing-masing pihak yang membuat perjanjian. Muzara’ah lahan pertanian di Desa Doho tidak menimbulkan gurur karena dengan pembagian 30% penggarap dan 70% pemilik lahan menganggap hal tersebut cukup adil sebab besar hak dan kewajiban masing-masing juga berbeda jauh. Jika terjadi permasalahan antara keduanya dalam menyelesaikannya menggunakan musyawarah mufakat.  Kata Kunci: Hukum Islam, Muzara’ah, Penggarap dan Pemilik Lahan.

Abstract

This study examines the application of murabahah contracts on pension financing products conducted at Bank Syariah Mandiri KCP Bondowoso between the bank and its customers based on DSN-MUI fatwa Number 4 of 2000 concerning murabahah financing and DSN-MUI fatwa Number 88 of 2013 concerning General Guidelines for Program Implementation Pension Based on Sharia Principles. The problems that will be answered through this research are: (1) How is the application of the murabahah contract to pension financing products in Bank Syariah Mandiri KCP Bondowoso? (2) What is the DSN-MUI fatwa review of the application of the murabahah contract to pension financing products at Bank Syariah Mandiri KCP Bondowoso? This research is field research, because research activities are conducted at Bank Syariah Mandiri KCP Bondowoso. The research approach used is a qualitative descriptive research approach. To understand and analyze the object under study, the author uses several approaches such as the legislative approach and the comparative approach. Data collection techniques using observation, documentation, and interview techniques. While the data analysis technique uses a comparative analysis method.The results of this study are: (1) The pension financing contract in Bank Syariah Mandiri KCP Bondowoso is carried out by using a murabahah contract by fulfilling the following conditions: (1) The contract is done by reciting ijab and qabul; (2) Contracts are clearly implemented; (3) The object of the contract has been fully owned by the bank before being offered to prospective customers; (4) Contracts are carried out by prospective customers and the bank voluntarily without any coercion or threat; and (5) Contract objects are goods that are not prohibited by sharia. In the event of default, the bank will carry out billing steps by sending a notification letter, collection letter, warning letter 1 to 3. If the customer becomes bankrupt, the Bank will give up the time when it is able to settle its obligations if the business is bankrupt in an agreement the bank with the customer at the time of the murabahah agreement. (2) In general, the application of murabahah contracts to pension financing products at Bank Syariah Mandiri KCP Bondowoso is in accordance with the DSN-MUI fatwa, both DSN-MUI fatwa Number 4 of 2000 concerning Financing of Murabahah, and DSN-MUI fatwa Number 88 of 2013 concerning Guidelines General Implementation of Sharia Principles Based Pension Programs. Keywords: Fatwa, DSN-MUI, Murabahah, Pension, Bank Syariah Mandiri.

Abstract

The background of this research is the exixtance of the difference opinion between ulama and moslem scholars about the law of interest in Islam, which is until now still not discovered the solusion opinion and it make interesting for the researcher to make a research about the object more deep and more wide. But the researcher will not use Islamic law perspective as analysis basic, the researcher will use the objectives of sharia as analysis basic.This research is limited by several problems as following: (1) Why bank interest is needed by conventional banks? And (2) How is the law of interest if observed from the objectives of syariah (maqashid sharia)?This research is a library research. In this research the researcher choose to use a conceptual approach because the purposes which need to be achieved trouhg this research is to result an Islamic law thought about the law of interest which is not being bounded by the opinions or theories launched by majority of the moslem scholar. So this research can originally refer to the objectives of the sharia as what has been agreed by majority of ulama.The results of this research there are: (1) the interest is a money amount addition which have to paid by bank to the costumer based on the loan percentage that given by bank to their customer. Bank interest is used for the Bank's operational costs, if there is no interest instrument, it is likely that the Bank will not be able to survive. And (2) there are three opinions of ulama’s law judgments about the law of interest, it is forbidden (haram), permitted (halal) and dubious (shubhat). If this law opinions observed based on the objevtives of sharia, the researcher can make a conclusion that the opinion which is permit the interest is the most according to the objectives of sharia, and it is related to the concept of hifz al-nafs (take care of soul) and hifz al-mâl(take care of property) than the opinion whih has been forbid the interest. The permitted law of interest in the concept of hifz al-nafs (take care of soul) can be located in the dharuriyah, hajiyah and tahsiniyah degrees. While The permitted law of interest in the concept ofhifz al-mâl(take care of property)can be located in the dharuriyah and hajiyah degrees. Keywords: Interest, Usury, Maqashid Sharia, hifz al-nafs (Take care of soul), hifz al-mâl (Take care of Property).

Abstract

This research discusses the Decision of the Mataram Religious Court Number 0508/Pdt.G/2016/PA. Mtr on how the judges resolved the issue of the dispute over the murabahah financing contract in the Mataram Religious Court. In analyzing the problem the author uses the theories of Islamic Economic Law as the basis of the analysis. the main issues that will be answered through this research include: (1) What is the judge's decision in case number 0508/Pdt.G/2016/PA. Mtr concerning the settlement of disputes in murabahah financing contracts according to the theory of Islamic Economics Law? (2) How is the judge's decision in case number 0508/Pdt.G/2016/PA. Mtr concerning the settlement of disputes in murabahah financing contracts according to the principle of justice in Sharia Economic Law? When viewed from the method of data collection, this type of research includes the type of library research because the data collection techniques that the authors chose in this study is techniques of collecting data through the documentation method. In analyzing the data the author uses a comparative approach to compare the practice of banking contracts - which in this study are the problems of murabahah and musyarakah financing contracts - as stated in the decisions of the Mataram Religious Court judges in accordance with the contract theory regulated in sharia economic law.The results of this study are: (1) Procedure for settling a dispute case in murabahah and musyarakah contracts carried out by the of judges through their decision Number 0508/Pdt.G/2016/PA. Mtr along with the contents of the decision according to the author in accordance with the rules stipulated in Sharia Economic Law. That is because the dispute resolution carried out by the judges is carried out based on legal rules in Sharia Economic Law, namely the rules for resolving sharia economic disputes contained in Law Number 21 of 2008 concerning Islamic Banking Article 55, Law Number 48 Year 2009 concerning Judicial Power Article 16 paragraph 2, Supreme Court Regulation Number 2 of 2008 concerning Compilation of Sharia Economic Law Article 133, and DSN-MUI Fatwa Number 4 concerning Murabahah, Number 8 of 2000 concerning Musyarakah Financing, and Number 47 concerning Settlement of Murabahah Receivables for Customer Can't Pay. (2) Decision of the judges in Case Number 0508/Pdt.G/2016/PA. Abstract

Penelitian ini mengkaji dan menganalisis secara mendalam mengenai putusan hakim Pengadilan Agama Blitar dalam perkara Nomor 3333/Pdt.G/2014/PA.BL dengan menggunakan pisau analisis teori wadi’ah, mudharabah, dan ijarah beserta prinsip-prinsip dalam hukum ekonomi syariah. pokok-pokok permasalahan yang akan dijawab dalam penelitian ini meliputi: (1) Bagaimana putusan hakim dalam perkara nomor 3333/pdt.g/2014/PA BL tentang penyelesaian sengketa akad yad dhamanah menurut teori wadiah, mudharabah, dan ijarah dalam Hukum Ekonomi Syariah? (2) Bagaimana putusan hakim dalam perkara nomor 3333/pdt.g/2014/PA BL tentang penyelesaian sengketa akad yad dhamanah menurut prinsip-prinsip Hukum Ekonomi Syariah? Berdasarkan perolehan data yang dilakukan, jenis penelitian ini termasuk jenis penelitian kepustakaan (library research). Penelitian ini merupakan penelitian deskriptif kualitatif karena dalam penelitian ini penulis akan menjelaskan fakta hukum berupa putusan hakim tentang sengketa akad perbankan yang kemudian akan dilanjutkan dengan kajian analisis kritis terhadap putusan tersebut.Hasil penelitian ini adalah: (1) Berdasarkan kajian teori hukum ekonomi syariah terhadap putusan hakim dalam perkara nomor 3333/pdt.g/2014/PA BL, dapat disimpulkan bahwa putusan hakim tersebut lebih sesuai disebut sebagai akad wadi’ah yad dhamanah daripada sebagai akad kerja sama, karena terdapatnya unsur-unsur akad wadi’ah yad dhamanah dalam perjanjian yang dipersengketakan di atas. Sebaliknya, putusan tersebut bertentangan dengan teori akad mudharabah dan ijarah karena tidak terpenuhinya rukun dan syarat akad tersebut dikatakan sebagai akad kerja sama dan atau ijarah. (2) Putusan hakim dalam perkara nomor 3333/pdt.g/2014/PA BL tidak sejalan dengan prinsip ketuhanan dengan alasan bahwa hakim tidak mengambil konsep-konsep dalam hukum ekonomi syariah sebagai landasan memutuskan perkara sengketa tersebut. Selain itu, putusan hakim di atas apabila dilihat dari prinsip keadilan dan kejujuran, menurut analisis penulis, putusan tersebut belum sejalan dengan prinsip keadilan dan kejujuran.
