Jurnal Simbur Cahaya merupakan jurnal ilmiah yang dikelola oleh Fakultas Hukum Universitas Sriwijaya. Penamaan jurnal ini tidak terlepas dari sejarah yang dimiliki masyarakat Sumatera Selatan, khususnya mengenai keberadaan Kitab Simbur Cahaya pada zaman dahulu. Kitab Simbur Cahaya merupakan peninggalan dan hasil tulisan dari Ratu Sinuhun (istri penguasa Palembang yang berkuasa antara tahun 1636 sampai 1650). Beberapa ahli sejarah meyakini bahwa Kitab Simbur Cahaya merupakan kitab pertama yang diterapkan masyarakat nusantara, berupa undang-undang tertulis yang berdasarkan syariat Islam. Cerita lain menyebutkan bahwa Kitab Simbur Cahaya berkaitan erat dengan cerita munculnya sinar terang benderang di Bukit Siguntang dalam rangka menyambut kelahiran keturunan Raja Iskandar Zulkarnaen dan menjadi penanda pengesahan tiga raja muslim di tiga serumpun Melayu, yakni Palembang, Singapura dan Malaka. Secara etimologis simbur cahaya diartikan sebagai “percik sinar atau cahaya”, cahaya yang dimaknai sebagai obor dalam peradaban masyarakat Sumatera Selatan. Dalam Kitab Simbur Cahaya terkandung nilai-nilai moral serta perpaduan antara hukum adat dan ajaran agama Islam. Undang-undang Simbur Cahaya merupakan kitab undang-undang hukum adat yang memadukan antara hukum adat yang berkembang secara lisan di pedalaman Sumatera Selatan dan ajaran Islam. Kitab ini terdiri dari lima bab, yang membentuk pranata hukum dan kelembagaan adat di Sumatera Selatan, khususnya terkait persamaan gender perempuan dan laki-laki. Secara garis besar, isi undang-undang tersebut adalah sebagai berikut: 1) Adat Bujang Gadis dan Kawin; 2) Adat Marga; 3)Aturan Dusun dan Berladang; 4)Aturan Kaum; 5)Adat Perhukuman. Berdasarkan optimisme dan nama besar Kitab Simbur Cahaya maka Fakultas Hukum Universitas Sriwijaya berusaha memberikan tempat bagi para peneliti, mahasiswa, praktisi dan akademisi untuk terhimpun dalam wadah ilmiah yakni Jurnal Simbur Cahaya. Jurnal Simbur Cahaya adalah jurnal berkala ilmiah Ilmu Hukum yang diterbitkan oleh Fakultas Hukum Universitas Sriwijaya. Terbit per-periodik bulan Juni & Desember dengan artikel yang menggunakan Bahasa Indonesia dan Bahasa Inggris. Jurnal Simbur Cahaya merupakan sarana publikasi ilmiah yang memenuhi standar kualifikasi jurnal nasional terindeks SINTA dan diharapkan dapat ditingkatkan menjadi jurnal internasional. Jurnal Simbur Cahaya diperuntukkan bagi akademisi, peneliti, mahasiswa pascasarjana, praktisi, serta pemerhati hukum. Lingkup tulisan dalam Jurnal Simbur Cahaya merupakan artikel hasil penelitian atau artikel review kasus hukum. Artikel-artikel tersebut seyogyanya mampu menjawab aneka permasalahan hukum yang dapat dipertanggungjawabkan melalui bentuk tulisan ilmiah. Sebagaimana sejarah awal terbitnya, Jurnal Simbur Cahaya banyak menyoroti kajian hukum kontemporer seperti Hukum Tata Negara, Hukum Administrasi Negara, Hukum Perdata, Hukum Pidana, Hukum Internasional, Hukum Lingkungan, Hukum Islam, dan Hukum Adat.

Abstract

The mortgageis legal protection for the creditor if the debtor cannot perform its obligation to pay off the debt to the creditor. Repayment of creditor debt is made by selling the object of guarantee of mortgage rights through public tender. The auction process will result in legal effect, namely the transfer of rights of auction object from the seller to the auction winner. This research is aimed to know the execution auction of mortgage right  State Property Office and Auction (KPKNL) Pekanbaru, the legal consequences for the auction winner who can not control the auction object of mortgage execution, and the legal protection to a winner of the auction of mortgage execution. The research me tho duse disjuridical empirical with an alytical, descriptive research specification. Primary and secondary data were obtained through a literature study and a survey.  Data collection tools are interviews. Data obtained is analyzed quantitatively.  The result of there searchs how sthat the executio nauction of mortgage rightsat KPKNL Pekanbaru is implemented based on the Regulation of Minister of Finance of the Republic of Indonesia Number 27 / PMK.06 / 2016, and is related to Regulation of the Minister of Finance Number 106 / PMK.06 / 2013 regarding the amendment to Regulation of the Minister of Finance Number 93 / PMK.06 / 2010 concerning the instruction of auction implementation. In respect of the legal consequences of the auction winner being unable to control the auction object, the auction winner may apply for the auction of auction object to the head of the local district court. The auction treaty normatively supports the legal protection of the winner of the auction as an authentic deed. However, a legal certainty to control the objec to fanauction is not obtained as the law does not explicitly regulate the protection of the winner of the auction.

Abstract

Advanted in science and technology in this globalization era have a profound influence on every human’s activities in this world. Dispite its benefits, globalization has its negative im pacts, like as dependency of human on technology, until led to a progressively increasing number of transnational crime. Based on the results of this research, we know that ASEAN as a regional international organization, have not been able to maintain the security of this area, and also it’s because strategical policy is not comprehensive, because some crimes don’t have any legal instruments that bind every ASEAN states.  One of the crimes that have not been regulated in ASEAN is “Illicit Arms Trafficking”. Borrowing the definition used by the United Nations, illicit trafficking is the movement of weapons that is “contrary to the laws of States and/or international law.” This phenomenon is of growing concern because it has the potential to undercut government efforts at establishing stability and order. Governments in Southeast Asia are worried about the growing illicit trade in small arms because a number of factors have allowed it to flourish steadily such as inadequate controls against illicit weapons production, exports and imports at the national level due to poorly trained and/or corrupt officials, financial and technological difficulties in implementing effective controls, lack of coordination and cooperation among regional states in monitoring the circulation and supply of weapons from within and outside of the region; and, non-existence of international or regional agreements on controlling the small arms trade (licit and illicit). Other obstacles that the breadth of water areas in Southeast Asia that so complicate ASEAN to kept an eye on any potential occurrence of transnational crime, including Illicit arms trafficking

Abstract

The Board of Commissioners is a corporate organ that has the duty to carry out supervision in general and / or specifically in accordance with the articles of association and provide advice to directors. The organ of the commissioner is selected by the General Meeting of Shareholders (GMS) must also be responsible to the GMS. As a supervisor of the performance of the board of directors, what is the responsibility of the commissioner if the company suffers a loss. Legal research used is normative legal research. Normative legal research is legal research that puts law as a system of norms. The norm system in question is regarding principles, norms, rules of law and regulations, court decisions, agreements and doctrines (teachings). In carrying out its duties if the company loses, each member of the board of commissioners is personally responsible for the company's loss if the person concerned is guilty or negligent in carrying out his duties. In the event that the board of commissioners consists of two or more commissioners, the responsibility applies jointly to each member of the board of commissioners. Exceptions to this responsibility are if the member of the commissioner can prove that he has carried out supervision in good faith and prudence for the benefit of a Limited Liability Company (PT) and in accordance with the purpose of the PT, and does not have personal interests, directly or indirectly, for resulting in losses, and has provided advice to directors to prevent the occurrence or continuation of such losses

Abstract

State Owned Enterprise (SOE) is a strategic business entity in Indonesia, or in other countries. Since 1945, laws on Indonesia SOE had been changed 4 times, in four periods namely, 1945-1960 period, 1960-1969 period, 1969-2003 periode, and 2003-now. The law change has been driven Indonesia’s SOE concentrates on two principles profitable and  cost-benefit recovery principles. The law change has caused loosened   relation pattern between Indonesia state with SOE, then  the Indonesia’s  SOE metamorphed  into commercial business entity.

Abstract

Government Regulation in Lieu of Law (PERPPU) Number 1 Year 2017 regulates the Authority of the Director General of Tax the Ministry of Finance has access to financial information for tax purposes. This information can be obtained from financial service institutions carrying out activities in the banking sector, capital market, insurance, other financial service institutions and/or other entities categorized as financial institutions. Through this Government Regulation, the government also eliminates the confidentiality rules of financial service institutions related to opening financial access of customers or taxpayers as contained in Article 2 Paragraph stating in terms of financial service institutions, other financial service institutions, and/or other entities as referred to Paragraph 1 are bound by the obligation to keep confidential based on the provisions of the laws and regulations, the confidentiality obligation does not apply in implementing the Government Regulation. The state of urgency also means that in the General Provisions and Taxation Procedure law regulates data access through requests (by request) and only covers the purpose of inspection, investigation and collection of taxes, precisely here the problem lies in the absence of accurate initial data tax audits are not effective and prone to cause disputes that are endless winding. The government guarantees the confidentiality of public data submitted by financial institutions to the DGT, tax officials who divulge confidential taxpayers and use the information for purposes other than fulfilling tax obligations, will be subject to sanctions according to general provisions and taxation procedures.

Abstract

Business competition law requires the creation of national economic efficiency and the effectiveness and efficiency of business activities as contained in the purpose of the establishment of Law No.5 of 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition. The effectiveness and efficiency of business activities are directed at creating healthy competition between business actors. While national economic efficiency is directed at fulfilling the needs of the lives of many people with indicators of increasing public welfare. One of the efforts to achieve these two things was done by enacting the de-monopolization policy of State-Owned Enterprises (BUMN), in which state-owned companies that had monopoly rights in certain business sectors, their monopoly rights were revoked by giving opportunities to the private sector to compete. The study of how the de-monopolization policy of SOEs can create a healthy business competition climate for the fulfillment of the needs of the people's lives is the focus of the discussion in this article. The discussion will be conducted using the documentary research method that places secondary data as the main analysis material. Analysis using a legislative approach, and a historical approach will be able to answer the problems that use the principle of benefit and principle of justice that can be used as a government consideration in enforcing the de-monopolization policy of SOEs. The main target of the de-monopolization policy of SOEs is to protect the lives of many people by guaranteeing the fulfillment of quality living needs

Abstract

The Role of Head of Gantung Sub-distric as a Facilitator in The Preparation of Jangkar Asam’s Village Governance Implementation Reportatthe end of Fiscal Year 2015. This study describes the role of head of Gantung sub-distric (Camat Gantung) as a facilitator in the preparation of Jangkar Asam’s village governance implementation (LPPDes) reportat the end offiscal year 2015. This research is qualitative descriptive interpretive. The data were collected by means of deep interview. The researcher suggests that the Headof Belitung Timur regency needs to issue a regent regulation that clearly defines forms and limits of facilitation rolesthat should be done by Camat Gantung. In term of enhancing the facilitative and skill role of providing supports and organizing, Camat Gantung and his staff need to improve their competences by following the education and training, technical guidance and workshop about community worker and they also need to build cooperation with the other community workers to assist the Village Government of Jangkar Asam. For applying the role and skill facilitation of social animation, utilization of skill and resource and personal communication, Camat Gantung need to multiply the interaction with Village Government of Jangkar Asam in formal meetings such as open dialoge and discussion and non-formal meetings such as individual consultation and coordination.
