Jurnal Simbur Cahaya merupakan jurnal ilmiah yang dikelola oleh Fakultas Hukum Universitas Sriwijaya. Penamaan jurnal ini tidak terlepas dari sejarah yang dimiliki masyarakat Sumatera Selatan, khususnya mengenai keberadaan Kitab Simbur Cahaya pada zaman dahulu. Kitab Simbur Cahaya merupakan peninggalan dan hasil tulisan dari Ratu Sinuhun (istri penguasa Palembang yang berkuasa antara tahun 1636 sampai 1650). Beberapa ahli sejarah meyakini bahwa Kitab Simbur Cahaya merupakan kitab pertama yang diterapkan masyarakat nusantara, berupa undang-undang tertulis yang berdasarkan syariat Islam. Cerita lain menyebutkan bahwa Kitab Simbur Cahaya berkaitan erat dengan cerita munculnya sinar terang benderang di Bukit Siguntang dalam rangka menyambut kelahiran keturunan Raja Iskandar Zulkarnaen dan menjadi penanda pengesahan tiga raja muslim di tiga serumpun Melayu, yakni Palembang, Singapura dan Malaka. Secara etimologis simbur cahaya diartikan sebagai “percik sinar atau cahaya”, cahaya yang dimaknai sebagai obor dalam peradaban masyarakat Sumatera Selatan. Dalam Kitab Simbur Cahaya terkandung nilai-nilai moral serta perpaduan antara hukum adat dan ajaran agama Islam. Undang-undang Simbur Cahaya merupakan kitab undang-undang hukum adat yang memadukan antara hukum adat yang berkembang secara lisan di pedalaman Sumatera Selatan dan ajaran Islam. Kitab ini terdiri dari lima bab, yang membentuk pranata hukum dan kelembagaan adat di Sumatera Selatan, khususnya terkait persamaan gender perempuan dan laki-laki. Secara garis besar, isi undang-undang tersebut adalah sebagai berikut: 1) Adat Bujang Gadis dan Kawin; 2) Adat Marga; 3)Aturan Dusun dan Berladang; 4)Aturan Kaum; 5)Adat Perhukuman. Berdasarkan optimisme dan nama besar Kitab Simbur Cahaya maka Fakultas Hukum Universitas Sriwijaya berusaha memberikan tempat bagi para peneliti, mahasiswa, praktisi dan akademisi untuk terhimpun dalam wadah ilmiah yakni Jurnal Simbur Cahaya. Jurnal Simbur Cahaya adalah jurnal berkala ilmiah Ilmu Hukum yang diterbitkan oleh Fakultas Hukum Universitas Sriwijaya. Terbit per-periodik bulan Juni & Desember dengan artikel yang menggunakan Bahasa Indonesia dan Bahasa Inggris. Jurnal Simbur Cahaya merupakan sarana publikasi ilmiah yang memenuhi standar kualifikasi jurnal nasional terindeks SINTA dan diharapkan dapat ditingkatkan menjadi jurnal internasional. Jurnal Simbur Cahaya diperuntukkan bagi akademisi, peneliti, mahasiswa pascasarjana, praktisi, serta pemerhati hukum. Lingkup tulisan dalam Jurnal Simbur Cahaya merupakan artikel hasil penelitian atau artikel review kasus hukum. Artikel-artikel tersebut seyogyanya mampu menjawab aneka permasalahan hukum yang dapat dipertanggungjawabkan melalui bentuk tulisan ilmiah. Sebagaimana sejarah awal terbitnya, Jurnal Simbur Cahaya banyak menyoroti kajian hukum kontemporer seperti Hukum Tata Negara, Hukum Administrasi Negara, Hukum Perdata, Hukum Pidana, Hukum Internasional, Hukum Lingkungan, Hukum Islam, dan Hukum Adat.

Abstract

Criminal law aims to prevent or inhibit the actions of the community that are not in accordance with applicable legal rules. The problem of criminal conviction or imposition is very interesting. Not because of the good enforcement process but the poor views of the public (society) of Indonesia and the international community. Judge's decisions are often considered not to fulfill a sense of justice for the community, which in this case is the case of Grandma Minah who was found guilty of stealing 3 cocoa fruits. If the case is compared to the imposition of a sentence on cases of corruption, then this is felt to be inappropriate. Law enforcement in Indonesia is likened to a sharp knife down but blunt up. Against this criminal imposition it can be seen also from American realism and Scandinavian realism towards criminal prosecution, in this case American realism views the law based on the judge's decision, which is inversely proportional to the view of Scandinavian realism. The method in this paper is interdisciplinary with a socio-legal studies approach, namely by using an approach that focuses on seeing the law through a combination of normative analysis [juridical legal norms] and non-legal science approaches. The nature of socio-legal is prescriptive translation by providing solutions to legal problems, combining normative analysis and no-legal / social aspects approaches. From the research it can be concluded that the realist approach has been charged with causing a lot of confusion and overload of the role of judges in forming and making laws. Such a view assumes that law is not what is carried out by a court, but a court is an institution that implements the law. If the judge tends to follow the law, it will be very easy to predict what the judge has decided in many cases. The legal definition that states the law as what is decided by the court, is the same as stating that the drug is what is written on prescription paper by a doctor

Abstract

Article of Law No. 31 of 1999 which was amended and Supplemented by Law No. 20 of 2001 concerning Eradication of Corruption Crime are explained that prosecutors as state lawyers can make civil claims to restore State financial losses. This type of research is juridical-normative research using a legal, conceptual, and case approach. The results of the analysis of researchers, that the duty of the Prosecutor is not only limited as a Public Prosecutor in criminal cases, in this case the Civil Prosecutor's Law also has the duty, authority and role as a State Attorney in terms of returning as much as possible in eradicating criminal acts of corruption. This is in accordance with the civil lawsuit filed by the Prosecutor in case No.24/Pdt.G/2008/PN.Kpj.

Abstract

Indonesia is a constitutional state is regulated in Article 1 verse (3) of the 1945 Constitution of the Republic of Indonesia. Its logical consequence is that every Indonesian citizen must submit to and obey the applicable law, legislation in this case. In its development, the law is expected to be constantly able to answer change and challenge of the people in changing time. Law is expected to always accommodate people to find the answers. It is in line with the Industrial Revolution 4.0 which currently happens. In this case, Artificial Intelligence is intended to support the forecasting and ranking on the matters which might require legislation in the future

Abstract

The marriage covenant is an agreement made by two people, a man and a woman, with the real purpose of forming a happy and eternal family based on belief in the one and only God as the first principle in Pancasila. A marriage will result in a marriage of wealth. The marriage agreement is an agreement between the prospective husband and the prospective wife to regulate the marital consequences of their property deviating from the union of wealth. In Article 147 of the Civil Code and Article 29 of Law Number 1 the Year 1974 concerning marriage, the legal act of making Marriage Agreements is made before or at the time of marriage takes place. However, with the issuance of Constitutional Court Decision No. 69 / PUU-XIII / 2015, there are some changes in the Marriage Agreement, which is still a pro and contra in society. The problems studied in this research is the effect of the Law of Marriage Agreement on the Creditor as a Third Party. The method used is normative legal research. The source of legal material used is primary and secondary sources in the form of books and legislation. The research shows that the legal consequences of the Marriage Agreement, made after the marriage by the Parties before the Notary,  amends the legal mechanism for the making of the marriage agreement. It now can be made by a Notary without having to be preceded by requesting a judgment of the Court as long as the marriage bond takes place. Whereas the legal effect on the property that has been contracted to a third party, in this case, the creditor, is that the creditor can file the Lawsuit to the Court. If the Creditor can prove that the security of the debt or the agreement as collateral in any form acquired before the marriage agreement is made, then the Creditor may demand repayment of the joint property of the husband and wife.

Abstract

ICSID Arbitration as an institution under World Bank is an institution as a dispute settlement, special for handling in the field of investment. As a dispute resolution Institution, ICSID Arbitration has its own mechanism on finishing a dispute which filed, where the steps and mechanism were different with other arbitration Institution. Therefore, there were some question about how this mechanism done well by this ICSID Arbitration in finishing investment dispute. This research used normatif research method which has qualitative to search a implementation based on ICSID Convention, Regulation and Rules of Procedure, the United Kingdom- Indonesia Bilateral Investment Treaty and Republic of Indonesia National Law included. From this research could be known that this investment consisted of some steps, they were file request, screening of a request and registration, number of arbitrators and method of appointment, selection and appointment of Tribunal members, constitution of the Tribunal, first session, other procedures (for Churchill Case only provisional measures used), written procedure, evidence, oral procedure, deliberations, until publication of award.

Abstract

The Constitutional Court as an Indonesian state institution in the judicial review of the law against the 1945 Constitution of the Republic of Indonesia has been regulated by Law Number 24 Year 2003. Testing the Act against the Constitution of the State of the Republic of Indonesia Year 1945 to produce an amar decision of the Constitutional Court in practice should still refer to the provisions of the Constitutional Court Law is Article 56 of the Constitutional Court Law. The research method used is prescriptive legal research, with the approach of legislation, case approach and historical approach. The types and sources of legal materials include primary and secondary legal materials. The technique of drawing conclusions using deductive thinking logic is the way of thinking of general statements drawn conclusions that are specific to obtain answers to the problems to be discussed in this journal thesis.Based on the result of the research, the decision of the Constitutional Court namely the ruling declared the request is unacceptable, the verdict states the petition is granted, the verdict says the petition is granted, and the verdict declares that the verdict is rejected. The result of the research about the ruling in practice in the process of examining the law against the 1945 Constitution of the State of the Republic of Indonesia in the Constitutional Court is based on the results of the study of the 2016, 2017 and 2018 decisions are varying rulings namely the decision of the Constitutional Court which states to grant partial, denied part of it, declared void, declared unauthorized, declared the interlocutory / provisional, declared withdrawn, refused entirely, granted whole and unacceptable. The decision of the Constitutional Court should be the ruling that has been regulated in accordance with Article 56 of Law Number 24 Year 2003 regarding the Constitutional Court. Institutions of the Constitutional Court on the verdict should still refer to the provisions of the ruling as stipulated and regulated in the Law of the Constitutional Court itself. The House of Representatives (DPR) body needs to supplement the provisions of Article 56 of Law Number 24 Year 2003 regarding the Constitutional Court as amended into Law Number 8 Year 2011 regarding the amendment of Law Number 24 Year 2003 The government or the President needs to support the fulfillment of the legal basis to accommodate the varied decisions of the Constitutional Court.

Abstract

Indonesia is one of the countries that embrace the democratic system in running the goverment. One manifrstation of democracy is the General Election (GE). In the end, people’s power apparently still has a large role in the General Election. This can be seen from the regional head election that took place in the city of Makassar. The people of Makassar preferred empty boxes rather than the sole candidate supported by political parties. This research discusses the juridical review of the victory of the empty box in the Regional Head General Election. This is a normative study with the types and sources of legal material taken from secondary data. The legal materials were gathered through literature review and analyzed qualitatively with deductive conclusions.The results of the study showed that the factors of sole candidates in the regional head elections were divided into juridical factors and non-juridical factors. Juridical factors started with the decision of the Constitutional Court Number 100 / PUU-XIII / 2015. Non-juridical factors are as follows: the nominating process requires high costs and the existence of money politics; weak competitiveness of candidates in political competition; the political interests of the political elite; and the failure of political parties to give political education to cadres. The legal consequence of winning an empty box against a sole candidate is that if the sole candidate loses a valid vote gain of less that 50%, then the next election will be held again in the following year
