Abstract

This paper endeavors to explore cotemporary epistemology of islamic economic schools classified into threecategories: Baqir Sadr, Mainstream and alternative schools. These mainstreams have been applying differenceapproaches and paradigms to analyze islamic economics. This study shows that islamic economics has ‘doubleparadigm’.Inthis case, paradigmis a model or frameworkfor observationand understanding, which shapesbothwhat wesee and howweunderstand it. this paradigmsareofferedbythe muslim economists and also areexertedto understand the islamic economics problemsin which the scientific problemin islamic economics istheoccurred-gapbetweentheories, normsand facts. Variousparadigmsof islamic economics — Subjectivism,Positivism,and Deterritorialism— areto understood and explained howthe gap betweennormand fact occursinislamic economics. this gap is a complex challenge that must be understoond and explained byapplying amulti-disciplinerapproach.

Abstract

When we come across to the name Syekh Siti Jenar, our mind will turn to one of the most famous walis (Moslemmystics) in the history of Indonesia. Syekh Siti Jenar is famous both for ordinary people as well as intellectualscholars dealing with the history of Islam and mysticism in Indonesia. Some people doubt that this Syekh is reallya historical personality, but more people believe the existence of Syekh Siti Jenar is real. The life and teachingsof Syekh Siti Jenar as exposed by many books immediately remind us of those of the martyr Sufi al-Hallâj(244-309 H/857-922 AD). There is striking similarity between two personalities despite many differences. Itis suggested that the written sources seem to make easy and simple the doctrine of Siti Jenar and even said thatthe mystical teachings of him are clear and open to everyone; while in fact, they are not.

Abstract

In 2003, the government issued the law no.18 on the lawyer that creates a new opportunity for the graduatesof the Sharia Faculty to become a lawyer for the court. Before this year, this profesion was a privilage to thegraduates of the Law Faculty. Data shows that there are only two lawyers graduated from the Sharia Faculty’swho have become this profession. Thus, it is necessary to observe how they run their role in giving legal advicesto the parties, and also to examine the preferences of the clients between the lawyers graduated from the Shariahfaculty and the Law Faculty. This study reveals that the lawyers graduated from the Sharia Faculty tend tohave clients who were exercising the case in the Islamic Court rather than other courts. Further, the clients’spreference is mostly to the lawyers graduated for the Faculty of Law. It suggests that it requires to stimulate thestudents of the Sharia Faculty to be interested to become a lawyer.

Abstract

The history of Islamic economics uncovers that weight and measurement tools used by traders or sellers wereregularly supervised by the government’s institution, called al-ḥisba. Parallel to this historical fact, in Indonesiathe similar institution is currently placed under the authority of the Ministry of Trade and Commerce regulatedunder the Law No.2 of 1981. This study focuses to the actual practices of the law. Data for this study is gatheredfrom conducting serial interviews with traders, the authorities and conducting observation to the marketsactivities. The finding reveals that the authorized institution has not yet worked effectively in conducting itstasks that limitedly applies a seal to the measurement tools. These practices have untouched moral aspect of thebusiness activities. It hardly stepped forward to supervise the traders and sellers and also hardly applied lawenforcement. It suggests that this authorized institution, such as al-ḥisba, has the authority to enforce the lawin the framework of amar ma’ruf nahy munkar.

Abstract

Indonesian literature in West Sumatra in the New Order era was centralized in order to maintain uniformity ofthe New Order to preserves the power. Some writers in West Sumatra, including A.A. Navis and Darman Moenir,took a role as agents of the centrality and uniformity in offering a particular standard for the writers, literary critics,and literary history in West Sumatra. This paper examines how the influence and impact on the standardizationof the literary critics, writers, and literary history in the area of West Sumatera in the Reformation era. This paperimplicitly uses Bourdieu's sociological theory, using primary sources of essays, notes, articles, and other forms. Thisstudy reveals that there have been number of attempts aiming to deconstruct standarization designed by the previousregime. However, those attempts were widely seen as attempts to destabilize situation in this area.

Abstract

Salah satu persoalan serius yang sering dihadapi oleh mahasiswa atau peneliti yang melakukan kajian tekstual atas sebuah teks adalah kekurangmampuan menempatkan teks yang dikajinyadalam sebuah kerangka teori dan perspektif tertentu yang cocok, serta menempatkan analisisnya dalam konteks yang lebih luas. Padahal, kemampuan memilih kerangka teori yang tepat serta analisiskontekstual itulah salah satu yang dapat menuntun peneliti untuk sampai pada sebuah simpulan tajamdan kontributif dalam bidangnya.Pada saat yang sama, para peneliti dan mahasiswa pribumi juga sering kurang memanfaatkansumber-sumber tekstual berupa manuskrip dalam mengkaji fenomena Islam Indonesia. Padahal,sumber-sumber tersebut banyak tersedia dalam berbagai bahasa lokal seperti Melayu, Jawa, Sunda,Bugis-Makassar, Wolio, dan lainnya. Mereka niscaya tidak akan menemui kesulitan jika mau membacamanuskrip-manuskrip dalam bahasa-bahasa lokal tersebut.

Abstract

The development of zakat practices in Indonesian Islam at the last two decades has shown that this religiousobligation has gradually been transforming from as merely religious matter shifting to economic factor as well.This study examines the actual practices of zakat among zakat payers (muzakki) took places in a state company,that is PT.Arun Lhokseumawe, North Aceh. For this purpose, a field research was carried out to this companythat has estabalished a zakat institution. This study uncovers that the empolyers of this company decided thatMuslim employees should deduct 2,5 per cent for the monthly salary for the zakat. Further, the ʿāmil of zakatdistributed the collected revenue to the zakat recipients (mutaḥiq) which are for education, public facilities suchas mosques, living cost of the poor, health care, small-scale-business investment and adminisntrative expanses.In other words the collected revenue was not only distributed for the consumtive purposses, but was also forproductive matters. However, the distribution of the revenue was still mainly for the consumtive purposses.

Abstract

This paper explores the position of Islamic populer book in socio-cultural setting of contemporary Muslim inIndonesia. It focuses on how publishing industries placed the books they published in relation with muslimsociety at large. Here, the book will be talked as cultural goods as well as economic goods. By way of that, itwill be seen that it is the economic motive which drive the differentiation of Islamic popular book, in termof genre, reader, market segment and title. The concept of the field of cultural production from Bourdieuancultural sociology shows that in a field like Islamic popular book production, legitimation and consecrationas cultural capital are gained from the consumers as well as from the competitor. This cultural capital can beconversed into economic capital, which is in its turn can be conversed again into more cultural capital.
