Abstract

AbstrakPasal 290 Undang-undang No. 37 Tahun 2004 Tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang pada intinya menerangkan bahwa tidak ada upaya hukum yang dapat dilakukan terhadap putusan pailit yang didahului oleh PKPU. Namun, dalam praktik pengadilan, masih terdapat penyimpangan yang dilakukan oleh Majelis Hakim Peninjauan Kembali Mahkamah Agung terhadap ketentuan tersebut. Penyimpangan tersebut dilakukan dengan menerima pengajuan permohonan peninjauan kembali terhadap perkara kepailitan yang didahului oleh PKPU yang sudah diputus oleh Pengadilan Niaga. Antara lain Putusan Mahkamah Agung No. 48.PK/Pdt.Sus-Pailit/2014 antara PT. Surabaya Agung Industrial Pulp & Kertas melawan Asiabase Resources PTE Ltd dan Putusan Mahkamah Agung No. 156.PK/Pdt.Sus/2012 antara Firma Litha&Co melawan Heryanto Wijaya,  PT. Bank Negara Indonesia (Persero) Tbk. Dan PT. Sumber Indo Cellular.

Abstract

Comparative products are very important and must be considered about it because, Industrial Design assesses the performance of products that can be proven from evidence that can be seen or assessed by clear eye such as photographic evidence, catalogs or other evidence that can be proved bye Industrial Design which has existed before. Industrial design is based on its external appearance which does not have an aesthetic impression and contradicts Article 1 point 1 of the Industrial Design Law and article 25 Paragraph 1 of the TRIPs agreement, which is form creation, solely for function or technical configuration. Aesthetically cannot be registered. In the absence of aesthetic elements, the product performance can be used as the basis for the absence of new industrial designs based on the principle of "Public Domain", considering the aesthetic elements are one of the requirements of an item that can be categorized as Industrial Design. In the other hand, the protection period has expired and became a "Public Domain" then it can be registered as an Industrial Design if it packed with an aesthetic elements. If an item does not have an aesthetic impression, it can be ascertained that the item is not an industrial design and can be possible not to have novelty and become public property. Aesthetic impressions do not contradict with the laws and regulations, but this is an important requirement so the design can be categorized as an industrial design. In ordinance No. 31 in 2000 concerning Industrial Design itself does not limit of the notion novelty and aesthetics so, the multiple interpretations are often occur.

Abstract

On 2013 Supreme court nullified Law Number 7 Year 2004 on water resources management, and reenacted Law Number 11 Year 1974 on irrigation. Law Number 7 Year 2004 considered to oppose Constitution because right to utilize water can be given to the private party or individual. Although, right to utilize water by private party have been constituted under Law Number 7 Year 2004 also have been nullified by Supreme Court; however it doesn’t close any possibilities for any private party or individual to be able to manage water resource, because on Law Number 11 Year 1974 constitute that legal entitiy, social enterprise or individual authorize to utilize water and/or water resource with certain requirement through gained permission from government. However, it is question; although Law Number 7 Year 2004 have been nullified but Law Number 11 Year 1974 still in place; though, both Laws constitute similar concept on water utilization.

Abstract

AbstractMaking transactions can get a lot of profit, then there are several ways, one of which is in the form of investing. To make investments can be done by individuals or a person entity that has excess funds or is often called a company securities. Regulations regarding risk in Municipal Bonds are not the same as arrangements in corporate bonds and corporate bonds themselves, basically payment of Municipal Bonds made by this Regional Government comes from funds from the utilization / use of infrastructure built from publishing the regional bonds and reserve funds in the APBD must be allocated to repayment. it is important to research how to regulate and the process of issuing regional bonds. From this background can be drawn formulation of the problem, namely, How to Analyze the regulation and issuance process of Bonds Regions in Indonesia?The results of the formulation of the problem that the author took was that all the rulesrelated to procedures and issuance of municipal bonds is clear and regulated in law -invite, namely Law Number 33 of 2004 concerning Financial Balance between the Central Government and Regional Government, Government Regulation Number 30 In 2011 concerning Regional Loans, Minister of Finance Regulation Number 180 / PMK.07 / 2015 concerning Amendments to Regulation of the Minister of Finance Number 111 / PMK.07 / 2012 concerning Procedures for Issuance and Accountability of Bonds Area. Issuance of bonds can also be done through a public offering.

Abstract

AbstractOnline lending is form of alternative funding resulted from financial technology innovation. Until February 2019 there are 99 financial technology corporations that engaged in lending activity that operated officially, legally, and recognized by Otoritas Jasa Keuangan. However, many problems arise form this innovation in form of online lending. Many consumers became the victims of either illegal or even legal online lending platforms. Started from the paramount loan interest applied in the online lending agreement until the amount of loan that need to be paid did not in accordance to the initial amount of debt, become core of the problems for the online lending consumers that treated unfair and unjustly by the online lending platform organizer. Moreover, online lending contract commonly belonged to the standard clause agreement that have been pre-arranged by one of the contracting parties. This research has purpose to determine the urgency of application of the proportionality principle on online lending contract. This research using doctrinal research method followed by conceptual and statute approaches. This research expected to generates conclusion on the notions of application of proportionality principle on online lending contract that included as standard clause contract in order to distribute contracting parties’ rights and obligations proportionally. Therefore, in future the online lending agreement could generate justice and proportional contract for contracting parties and the substance of the contract can reflect this proportionality principle.

Abstract

Pengelolaan kekayaan desa salah satunya adalah berupa Tanah Kas Desa dengan cara sebagai penyertaan modal dalam Badan Usaha Milik Desa diatur oleh Kementerian Dalam Negeri dan peraturan mengenai Pendirian Pengurusan Dan Pengelolaan Dan Pembubaran Badan Usaha Milik Desa diatur oleh Kementerian Desa, Pembangunan Daerah Tertinggal Dan Transmigrasi. Di satu sisi peraturan mengenai kekayaan desa berupa tanah tidak bisa dialihkan namun dengan berkembanganya desa pada saat ini dan memiliki otonomi sendiri melalui ditetapkannya Undang-Undang Republik Indonesia Nomor 6 Tahun 2014 Tentang Desa  untuk menuju desa yang mandiri, salah satunya perlu dilakukan peningkatan kemampuan perekonomian pemerintah desa untuk menyelenggarakan jalannya pemerintahan dan meningkatankan pendapatan masyarakat melalui berbagai kegiatan ekonomi. Pengelolaan Keuangan berupa pendapatan desa salah satunya berasal dari kekayaan asli desa dalam hal ini adalah Tanah Kas Desa. Sertifikat Tanah Kas Desa ini diatasnamakan Pemerintah Desa, selain dapat dikelola oleh Pemerintah Desa, dapat juga dikelola oleh Badan Usaha Milik Desa. Metode penelitian ini menggunakan metode penelitian normatif dengan pendekatan peraturan perundang-undangan dan pendekatan konseptual dengan mengumpulkan pendapat-pendapat para ahli hukum, bertujuan untuk mengetahui dan menganalisa status hukum Badan Usaha Milik Desa dan bentuk penyertaan modal tanah kas desa ke dalam Badan Usaha Milik Desa.

Abstract

The lack of understanding on land waqf creates many issues related to waqf itself, i.e. offers endowed land as deb’ts collateral. In Article 40 alphabeth (a) Law Number 41 Year 2004 on Waqf, there is prohibition to include waqf properties as collateral. Waqf properties’ status change that inchorent with Law Number 41 Year 2004 on Waqf, one of it is including land waqf as debt’s collateral will cause unwanted consequence on the collateral agreement itself. In fact, there are still violations on Article 40 alphabeth (a) Law Number 41 Year 2004 on Waqf. These situations are caused by minimum awareness on management of waqf properties from nadzir, heirs and bank as the creditor towards implementation of waqf properties’ status change. Therefore, consequence of waqf properties’ status change that violates Article 40 alphabeth (a) Law Number 41 Year 2004 on Waqf will not immediately null and void; however, debt’s repayment still needs to be fulfilled by debtor corresponds with Article 1131 BW. It required efforts to minimize issues on waqf through socialization of waqf towards nadzir, heirs, bank as creditor and wide community, especially waqf properties’ status change so there will not be any issues on implementation and management of waqf properties in the future.

Abstract

Keberadaan jaminan atau agunan dalam hal pemberian suatu kredit dianggap merupakan bagian yang penting, walaupun adanya jaminan ini dapat dikatakan sebagai sesuatu yang tidak mutlak. Adanya suatu jaminan merupakan upaya untuk mengurangi resiko yang lebih besar terhadap pemberian suatu kredit tersebut. Debitor seringkali percaya atas penyerahan benda jaminan kepada kreditor. Seorang debitor perlu memperhatikan apakah lembaga pembiayaan tersebut sedang menghadapi masalah hukum, seperti terancam dipailitkan. Yang dimaksud dengan keadaan kepailitan adalah lembaga pembiayaan selaku kreditor dalam perjanjian utang piutang tetapi ia merupakan debitor dalam perjanjian yang lain. Apabila suatu ketika kreditor tersebut jatuh pailit, maka seluruh kekayaan kreditor tersebut masuk dalam boedel pailit. Sedangkan para debitor yang mengikatkan diri pada kreditor tersebut dalam perjanjian utang piutang dengan memberikan suatu jaminan tertentu juga akan merasakan akibatnya. Dalam Pasal 33 UUJF dan Pasal 36 ayat (1) UU KPKPU nampak bahwa terdapat perlindungan bagi debitor terhadap kepailitan kreditor. Dimana debitor pada saat terdapat putusan pernyataan pailit terhadap kreditor dapat meminta kepada kurator mengenai kepastian dari kelanjutan perjanjian kreditnya tersebut.
